Preamble
These Bylaws of the Auckland City Council are made in
pursuance of the powers and authorities contained in the Local Government Acts
1974 & 2002, the Transport Act 1962, the Health Act 1956, the Burial and
Cremation Act 1964, the Standards Act 1988, and their amendments, and in
pursuance of all other powers and authorities contained in any other Act
enabling the Council in that behalf.
All previous bylaws enacted by the Council are hereby
revoked with the exception of the following:
- The Auckland City Consolidated Bylaw 1991 - Part 26 -
Water Supply;
- Part 16 - Water courses - of the Auckland City
Consolidated Bylaw 1988; (revoked by Amendment 9)
- The Auckland City Council and Auckland Harbour Board
Joint Foreshore Control Bylaw No.1 1983; (revoked by Resource Management Act
1991)
- Such provisions of the Bylaws of the Auckland City
Council as are necessary for the interpretation and administration of the Bylaws
specified in paragraphs (A) to (C) hereof.
Notwithstanding the repeal of any provision in the
Council's Bylaws every document or thing prepared or done pursuant to the
authority conferred by the provisions so repealed shall continue and have effect
if it could have been made or done under any corresponding provisions
substituted for the provision so repealed.
All approvals, licences, permits and acts of authority
which originated under any previous bylaw hereby repealed and all applications,
plans and other acts of parties and generally all documents, matters, acts and
things which so originated and are of continuing effect at the commencement of
the Auckland City Consolidated Bylaw 1998 shall, if they could have been made or
done under the corresponding provisions of the last mentioned bylaw, continue
and have effect accordingly.
Every provision in a bylaw repealed by Clause 4 that was
dependent for its validity upon the approval of a Minister of State or of an
Officer of Central Government shall continue in force until the corresponding
provision in this Bylaw has been similarly approved. The existing provision
shall be repealed on the eighth day following such approval, and the
corresponding provision in this Bylaw shall come into force at the same time.
