That the proposed private plan change and Concept Plan be adopted in respect the above provisions supported by the NZHPT.

Notwithstanding the above, the NZHPT requests some amendments to the proposed G008-14 Concept Plan, which it considers necessary to improve clarity for plan users in respect of some heritage matters. That the proposed G08-14 Concept Plan-Selwyn Heights Retirement Village be adopted but with the following amendments:
  • Following the list of activities and their status, introduce a new section before Development Controls to clarify any activity not specifically included within the proposed Concept Plan but which complies with the proposed development controls and any permitted activity that modifies one or more of the development controls are discretionary activities
  • List of permitted activities should include removal of those trees identified for removal
  • List of restricted discretionary activities should include the removal of protected trees and works within their drip line
  • Additional criteria for consideration for removal of protected trees not otherwise exempt by rule 9 should also include works within their drip line.
  • Concept Plan should make clear that the gate posts and carriage way are archaeological sites as defined under the Historic Places Act 1993
  • Concept Plan should include additional wording before Development Controls to clarify that the Council will require that the written approval of the NZHPT be sought or notice served when proposals affect the historic gate posts, the areas identified as areas of archaeological significance or route of the historic carriageway or the removal of a protected tree that aligned the historic carriageway (perhaps similar wording to 5C.7.1.3(C).

That the Proposed Concept Plan Diagram - Special Purpose 1 Zone be adopted as proposed provided that the Council is satisfied that the 8m height limits proposed within most of view shafts VC1 and VC2 will enable these views from Monte Cecilia Park to be protected and enjoyed.

If not, then this Diagram should be amended to show an appropriate lower height.

Either approve the plan modification subject to:
  • Redefine the "Areas of Archaeological Significance" to "Areas of Archaeological and Heritage Significance" to include the entire original alignment of the carriageway.
  • Prohibit new buildings or extension of existing building footprints within the entire alignment of the original carriageway
  • Include landscape controls that restore and maintain the legibility of the tree avenue and its connection to Pah Road.
  • Include conditions which see the original bluestone pillars retained in their current location
  • Provide a greater level of protection to the trees located within the original carriageway.
  • On the concept plan include reference to trees which were planted as part of the original carriageway.
  • Building heights in the western corner of the retirement village site are restricted to ensure that panoramic views from Monte Cecilia Park are retained.
  • Include landscape controls to ensure that landscaping is provided along the western and northern boundaries of the retirement village with Monte Cecilia Park.
  • Include conditions that provide controls for building facades along the northern and eastern boundaries of the retirement village with Monte Cecilia Park.
  • Amend the following bullet point under the subheading PERMITTED ACTIVITIES: "Additions and alterations to existing buildings, which comply with the development controls for the Concept Plan, provided that the gross floor area of the existing building does not increase by more than 10%, and the building height does not exceed 10m" to clarify that this refers only to existing buildings at the time the proposed plan modification was lodged.
  • Amend the definition of "Maximum Height" to remove ambiguity over heights and ensure total heights are defined by RL level (i.e. roof heights are incorporated into the definition maximum heights)

  1. The residential care facility (or any other building erected next to the residential 6a properties) on Pah Road be listed as a discretionary activity.
  2. That if the applicant intends to increase the Residential Care Centre (or any other building located within the 8 metre height zone) to more than 8 metres in total height the activity should be a non complying activity
  3. There be a rule inserted that requires Selwyn Foundation (or any other future owner/lessee of the village) to consult with the owners and occupiers of 2/157 and 155 Pah Road on the design and location of any building, landscaping and fencing proposed along their common boundaries. The outcome of the consultation shall be provided to the Auckland City Council with any application lodged with the Council.

That the development controls be altered as follows:

  1. The height of all the buildings within the 8 metre height limit area shall be 8 metres in total.
  2. Where the subject site abuts a residential property on Pah Road, the yard set back shall be a minimum distance of 10 metres.
  3. All service areas are to be located a minimum distance of 30 metres from the common boundary with sites being used for residential purposes. All servicing shall occur between the hours of 7 am and 7 pm.
  4. All air conditioning units (or other climate control devices) are to be located a minimum distance of 30 metres from the common boundary with sites being used for residential purposed.

  • That the attached amended 'Concept Plan Diagram' and amended 'Concept Plan text' replace the notified 'Concept Plan Diagram' and 'Concept Plan text', as it is considered that the proposed Concept Plan and related explanation does not provided sufficient clarity as to the likely indicative alignment of the former carriageway, that was historically associated with the Pah Homestead.

In particular,

  • That the attached amended 'Concept Plan Diagram' replace the notified 'Concept Plan Diagram'. It is proposed that the proposed viewshaft be amended by revising the point of origin (within Monte Cecilia Park), and the orientation of the view, as well adjusting the maximum permitted height for the prospective buildings within this south-western part of the site.
