Introduction

This policy on dogs is prepared in accordance with the requirements of the Dog Control Act 1996 ('the Act') and came into force on 1 June 2009.

This policy aims to give effect to the Act by protecting the health and safety of the public whilst ensuring the well-being and welfare of dogs is protected through responsible ownership.

The community expects people to be responsible dog owners. At the same time it is recognised that dogs can play a positive role in society and provide enjoyment for individuals and families.

Our objective

The overall objective of this policy is to encourage responsible dog ownership and community awareness to promote an environment where dogs and people can happily and peacefully co-exist.

In order to meet this objective, dog owners must:

1. register their dog/s by the time it is three months of age and every year after;
2. provide for the health and well being of their dog;
3. control their dogs when in a public place, especially in and near places frequented by children;
4. ensure their dog doesn't cause a nuisance to neighbours and other people by persistent and loud barking or howling;
5. keep their dog under direct control or confined on their property so it doesn't wander or become lost;
6. pick up any faeces left by their dog in public places or on land not occupied by the dog owner;
7. take all reasonable steps to ensure their dog doesn't injure, endanger, intimidate, or otherwise cause distress to children and other people so that the public can use streets and public amenities without fear of attack or intimidation;
8. take all reasonable steps to ensure their dog doesn't injure, endanger or cause distress to any stock, poultry, domestic animal, or protected wildlife and is kept out of prohibited areas;
9. ensure their dog doesn't damage or endanger any property belonging to other people;
10. provide for the training, exercise and recreational needs of their dogs.

1. Register your dog

All dog owners must register their dogs because the council needs to identify the person responsible for the care and control of every dog. All dogs first registered on or after 1 July 2006 will be required to be microchipped. From that date also, all dogs that are classified as dangerous or menacing under the Dog Control Act 1996, including dogs classified since 1 December 2003, will be required to be microchipped.

What will the council do to help achieve this?

1.1 Keep a register of dogs, provide information to the National Dog Control Information Database, set registration fees and provide dog owners with relevant information.

1.2 Inform and educate dog owners of the benefits of registration and microchipping.

1.3 Send annual registration renewal forms to all known dog owners.

1.4 Offer registration fee incentives for owners who have de-sexed their dog, passed a Dog Owner Licence test or paid their registration by the date given.

1.5 Take strong enforcement action against owners of unregistered dogs.
 

2. Provide dog exercise areas

The council must provide dog owners with a reasonable level of access to public places without compromising public safety and comfort (see appendices A - D).

What will the council do to help achieve this?

2.1 When making bylaws controlling the access of dogs to public places, the council will:

2.1.1 recognise the right of children and the general public to use public places without fear of attack or intimidation;

2.1.2 recognise the responsible dog owner as a user of public places;

2.1.3 aim for peaceful co-existence between dogs and their owners with other park users

2.1.4 provide dog access to parks and reserves on a city-wide basis;

2.1.5 provide for dog owner needs with bins for dog faeces in designated dog exercise areas and public places;

2.1.6 ensure that designated dog exercise areas and playgrounds are well sign posted and information is easily accessible for both dog owners and the general public;

2.1.7 aim to provide suitable signage in areas where dogs are prohibited, where they are required to be on a leash and where they can be off leash;

2.1.8 protect sensitive public areas and significant ecological areas from dogs, such as areas where dogs may be a danger to children, wildlife or other animals, or where their presence may be offensive or disturbing, e.g. cemeteries.'

2.2 The council will make bylaws that are consistent with the above principles which:

2.2.1 identify public places where dogs can either be exercised off a leash, or are required to be on a leash, or where they are prohibited;

2.2.2 recognise that dogs confined in a vehicle or cage, dogs taking part in council-approved special events or working dogs carrying out work duties should not be prohibited from public places or required to be on a leash;

2.2.3 require dog owners to, on all areas other than their own property, immediately remove any faeces left by their dog.

2.3 Inform dog owners of land within Auckland City that is included in a controlled or open dog exercise area under the Conservation Act 1987 or is a national park under the National Parks Act 1980.

2.4 Take enforcement action against owners who breach the Act or the Dog Control Bylaw by failing to contain or control their dogs.
 

3. Encourage responsible dog ownership

Dog owners must be encouraged to meet their obligations under the Act, to protect their dog's health and well-being and to ensure that neighbourhoods remain safe and pleasant. A responsible dog owner will:

• when purchasing a dog, ensure that the dog is suitable to their needs and their ability to care for the dog;
• provide the exercise space needed for the breed;
• when in a public place carry a bag to pick up their dog faeces;
• ensure that faeces will be picked up;
• attend appropriate dog owner and training courses; and
• when visiting the Hauraki Gulf Islands ensure that their dog/s don't enter private land, prohibited Department of Conservation areas or ecologically sensitive areas such as those on Great Barrier Island.

What will the council do to help achieve this?

3.1 Reward dog owners demonstrating a specified level of responsible dog ownership.

3.2 Provide information on council's website on the size of various dogs and the exercise needs of the various breeds.

3.3 Include within the Dog Control Bylaw, limitations on the number of dogs that can be kept.

3.4 Ensure dog owners take the necessary steps to ensure their dog's health and well being.
 

4. Enforce dog owner obligations

Powers of enforcement under the Act should be used appropriately to ensure public safety and comfort and to penalise and deter irresponsible dog ownership.

What will the council do to help achieve this?

4.1 Establish a response service to receive, investigate and resolve dog complaints from members of the public.

4.2 Remove dogs threatening public safety and comfort.

4.3 Assist dog owners and the public by:

1. giving out good dog owner information; or
2. issuing warnings; or
3. where appropriate issuing infringement notices, prosecuting owners and where required using menacing dog, dangerous dog, probationary and disqualified dog owner classifications; and
4. taking immediate enforcement action against unregistered dogs.

4.4 Require that dogs classified as menacing dogs be neutered within one month after receipt of notice of the classification.
 

5. Education

Dog control officers will work with schools, children and dog owners and the community so that the public is aware as to how to live with dogs.

What will the council do to help achieve this?

5.1 Inform and educate dog owners and the general public through media such as brochures, websites and school education programmes.

5.2 Promote the availability of dog obedience courses throughout Auckland City in City Scene.
 

6. Provide adequate funding for dog management services

Adequate funding must be provided to maintain an acceptable level of dog management services.

When considering dog-related fees, the council must take into account the user-pays principle, penalty-based fees, legislative requirements, the council's funding policies, community responsibilities and recognition of responsible dog ownership. Council's current policy is that dog registration fees pay for 60 per cent of dog management related costs.

What will the council do to help achieve this?

6.1 Set reasonable fees for the registration and control of dogs in accordance with the information above.

6.2 Set lower registration fees for working dogs and for owners demonstrating a specified level of responsible dog ownership.

6.3 Set a higher registration fee for owners who do not meet the date given for payment of registration fees.
 

7. Gather information to assess the effectiveness and fairness of our policy on dogs

Information will be gathered to determine if the council's methods are working towards achieving the objectives in this policy.

What will the council do to help achieve this?

Report annually on the council's administration of dog control methods and the dog policy. The council must give public notice of the report and send a copy of it to the Secretary for Local Government. Council will review the size and availability of off-leash dog exercise areas every 3 years. Tahuna Torea Reserve will not be included in this 3-yearly review.
 

8. Provide for special purpose dogs

Council will recognise that where a person with special needs (certified by a Medical Practitioner) requires a special purpose dog, that dog will be recognised as a working dog provided that dog has had training acceptable to the Manager of Auckland City Environments. This approval, where granted will allow the dog to enter public buildings and prohibited areas whilst it is working as a special purpose dog.

What will the council do to help achieve this?

Where a dog provides for the special needs of a member of the public and this is demonstrated to the satisfaction of the Manager of Auckland Environments, council will resolve that the dog will be a working dog for the purposes of Auckland City's Dog Control Bylaw.

Appendix A

Prohibited areas

Except where another schedule to this policy allows otherwise, every dog owner must ensure that his or her dog does not enter or remain in the following public places:

1. Any cemetery, crematorium or public building, including any library, swimming pool, recreation centre, and visitor centre, under the control or management of the council or the Auckland Regional Council unless permitted by the occupier or person having control of the premises and subject to compliance with any reasonable conditions imposed.
2. Any area developed or marked out as a sports field (but excluding any spectator area), outdoor court, skateboard ramp or bmx ramp or on or within 10 metres of any area that is developed or marked out as a playground or contains children's play equipment.
3. The area to the seaward side of Gordons Road and the beach adjacent to Whakanewha Regional Park (Waiheke Island).
4. The esplanade reserve adjacent to the Crown foreshore of Te Matuku Bay (Waiheke Island).
5. The following swimming areas:
   • the marked "safe swimming lane" on Kohimarama beach;
   • the swimming area in front of the bathing sheds on St Heliers Beach;
   • any other safe swimming areas or lanes marked out or identified by council.
6. The following islands in the Hauraki Gulf:
   • Motuihe
   • Browns Island
   • Rangitoto
   • Motutapu
   • Little Barrier
7. Any beach on the Isthmus (except Mission Bay) between 9am and 7pm during the period between the Saturday of Labour Weekend and Easter Monday inclusive (summer).

Note 1: before 9am of after 7pm dogs are required to be on a leash in this summer period

Note 2: there are some areas on Tamaki Drive where dogs can access the water directly from public steps.

8. On Mission Bay beach between 9am and 9pm during the period between the Saturday of Labour Weekend and Easter Monday inclusive (summer).
9. With the exception of (c) above any beach (except a beach in Appendix D) on Waiheke Island west of Piemelon Bay or Rocky Bay, and on Rakino Island, during the following periods:
   • The Saturday of Labour Weekend to December 23 inclusive, 10am to 4pm;
   • December 24 to February 1 inclusive, 10am to 6pm;
   • February 2 to Easter Monday inclusive, 10am to 4pm.
10. Tahuna Torea Reserve and the associated beach and foreshore, from the public walkway between 24 and 26 Vista Crescent to its boundary on West Tamaki and Tahaki Roads.
11. Any part of a park, reserve or public place when a permit has been granted to close that park, reserve or public place (or part thereof) for a special event or temporary activity for the duration of that event or temporary activity.

The following areas controlled by the Department of Conservation are also prohibited to dogs:

*These areas are Controlled Dog Areas (Prohibited Areas) under the Conservation Act 1987. Auckland City is required to identify land within the City that is controlled or open dog exercise areas under the Conservation Act and a national park under the National Parks Act. No bylaw is required in respect of these areas and they are included for information purposes only.

Appendix B

Leashed Areas

The following areas are leashed areas:

1. Any public place not included in Appendix A, C, or D of this policy.
2. Any road, including footpath and berm on Great Barrier Island and within the Isthmus area of the district.
3. Within Oneroa, Ostend and Surfdale village shops on Waiheke Island.
4. Any area that is developed or marked out as a picnic area, fitness apparatus area, wharf, boat ramp or boat marshalling area, and car park.
5. Any public area (except an area identified as a prohibited area in Appendix A or a designated dog exercise area in Appendix D) identified by the District Plan as a significant ecological area. Dogs must remain on a leash at all times in these areas and shall not be let off a leash to swim or walk in the water in these areas.
6. Any park, reserve or public place except when a permit has been granted to close that park, reserve or public place (or part thereof) for any special event or temporary activity (such as a concert, function, wedding, filming etc), for the duration of that event or temporary activity.
7. The following parks, reserves, beach areas and roads on Waiheke Island:
   • Fourth Avenue Reserve
   • Little Oneroa Beach Reserve
   • Onetangi Sports Park (marked playing fields)
   • Ostend Domain
   • Palm Beach Reserve
   • Surfdale Reserve
   • Tawaipareira Reserve.
   • That area of Blackpool beach between and including the Maori cemetery at the bottom of Tui St and Piritahi Marae at the bottom of Tahatai Rd
   • Natzka Rd where it runs parallel to and adjacent to Anzac Bay
   • Korora Road where if runs adjacent to Owhanake Reserve (69 Korora Road)
8. Hamlins Hill (Mutukarao) Regional Park.
9. On any beach on the Isthmus (except Mission Bay Beach) before 9am or after 7pm during the period between the Saturday of Labour Weekend and Easter Monday (summer) except any beach listed in Appendix A as a prohibited area.
10. On Mission Bay beach before 9am or after 9pm during the period between the Saturday of Labour Weekend and Easter Monday (summer).
11. On any beach (except any beach listed in Appendix A) on the Isthmus between 10am and 4pm from the Tuesday after Easter Monday until the Friday before Labour Weekend (winter).
12. On any beach on Great Barrier Island except a dog exercise area identified in Appendix D.
13. In any spectator area directly adjacent to a sports field, outdoor court, skateboard ramp or bmx ramp.

Appendix C

Off Leash Areas

The following are off-leash areas:

1. On any public place, road, footpath, berm, park or reserve on Waiheke or Rakino Island, except for those areas listed within Appendix A or B of this policy.
2. On any beach on the Isthmus between 4pm and 10am from the Tuesday after Easter Monday until the Friday before Labour Weekend (winter).
3. On any beach on the Isthmus (except a beach or swimming area listed in Appendix A) when the dog is swimming or walking in the water of the beach during the following times:
   1. before 9am or after 7pm during the period between the Saturday of Labour Day Weekend and Easter Monday (summer).
   2. at any time outside the period between the Saturday of Labour Day Weekend and Easter Monday (winter).
4. On any beach on Great Barrier Island (except on a beach or beach area where dogs are prohibited) when the dog is swimming or walking in the water.
5. On any beach on Waiheke Island west of Piemelon Bay or Rocky Bay, and on Rakino Island except during the following prohibited periods:
   • the Saturday of Labour Weekend to December 23 inclusive, 10am to 4pm;
   • December 24 to February 1 inclusive, 10am to 6pm;
   • February 2 to the end of Easter Monday inclusive, 10am to 4pm.

NB: These restrictions do not apply to the three Waiheke beaches in Appendix D.

Appendix D

Designated Dog Exercise Areas

Subject to the following time restrictions and any other conditions stated below, and providing the dog is kept under control, a dog owner may exercise his or her dog without it being on a leash in those public places in the following tables. Note that the Dog Control Act requires a leash to be carried even in an off leash area.

Time restrictions

For the purpose of this appendix, unless other times are stated, time restrictions apply during the period between the Saturday of Labour Weekend and Easter Monday (summer) between 8am and 7pm and from the Tuesday after Easter Monday until the Friday before Labour Weekend (winter) between 8am and 5pm. Parks or reserves in the following tables that are subject to time restrictions are also marked with an asterisk (*).

Note: Under the First Schedule Appendix A some parks or reserves may occasionally be closed for special events or promotions and dogs will be prohibited on the park or reserve during such occasions. In similar circumstances there may be times when dogs will be required to be on a leash if a special event or promotion is occurring (see Appendix B).
