Street trading policy
Auckland City Council is developing a series of street trading policies which will set out
the guidelines and criteria against which enforcement officers will consider applications
for street trading licences.
The policy is integral to the effective enforcement and management of the
council's Public places bylaw.

Street trading policy: The provision of outdoor dining and/or drinking
facilities in a public place
This policy guides the street trading activity of providing outdoor
facilities for the consumption of food and or drinks, including those offered by
a licensed premises.
Auckland has many opportunities for al fresco dining. Council has encouraged
this activity by licensing businesses to lease part of the footpath in front of
their establishments as long as the principal purpose of the resulting activity
is dining and/or drinking.
There has been a steady increase in the number of Street trading licence
applications for the provision of outdoor dining and/or drinking facilities.
The policy enables commercial operators to operate outdoor dining facilities
for an appropriate licence fee, provided the operation is adjacent to premises
used for the same purpose and that the activity:
- does not compromise street amenity
- does not compromise local character
- does not obstruct pedestrian flow
- complies with appropriate health and safety.

Street trading policy: the giving away of goods in
public places
This policy proposes that the giving away of goods can
occur in appropriate public places as defined by the policy for an appropriate
licence fee, on the condition that the activities:
- don't compromise open space amenity and quality or local character
- don't obstruct pedestrian flow and other recreational activities
- maintain appropriate health and safety.
We asked for feedback on the policy during September 2009 and this has been
incorporated into the refined draft policy.

Street trading policy: the sale of goods and services, including markets and
street stalls, in public places
Initial consultation was held with a selected group of stakeholders in late
2009 to learn about the issues experienced to inform the development of the
policy. Further development of this policy is currently on hold until the new
Auckland Council.
