  2. Top CONFIRMATION OF MINUTES

    The minutes of the Waiheke Community Board meeting held on Wednesday, 27 June 2007 to be confirmed as a true and correct record, with the following amendments reflected below in italics:

    4.1. KELLY BICKERTON and JULIE CRAWFORD - INCLUSION OF THE WAIHEKE ISLAND TOY LIBRARY IN THE NEW LIBRARY

    1. That the Waiheke Toy Library's request for space in the new library facility be supported in principle and that this request be forwarded to any consultants employed in the library development.

    4.8. WES BURNS - REMOVAL OF THE ANGLICAN CHURCH PROPERTIES

    Wes Burns addressed the Waiheke Community Board on a proposal for the removal of the Anglican Church Property at 131 and 133 Ocean View Road, Oneroa to the Waiheke Historical Society site at Onetangi to ensure preservation of this building. He raised concerns with the Board over the possible demolition of the building and requested action to ensure this did not occur.

    1. That Wes Burns be thanked for his presentation regarding the proposal to move the Anglican Church building at 131 and 133 Ocean View Road, Oneroa to the Waiheke Historical Society site at 165 Onetangi Straight, Onetangi.
    2. That the Waiheke Community Board support in principle the moving of the Anglican Church building from their current site to the Waiheke Historical Society site in Onetangi Road.
    3. That the Chairman be delegated to work with Wes Burns and the Waiheke Historical Society on the relocation of the Church building to Onetangi Road in order to ascertain:
      1. The funding implications of moving the building for report back to the Waiheke Community Board for consideration as a possible SLIPs project
      2. The logistical issues associated with the moving of the Church building.
    4. That the Waiheke Community Board requests assurances from Council that the Anglican Church building at 131 and 133 Ocean View Road, Oneroa, will not be sold, demolished or removed until investigations on their possible relocation to the Waiheke Historical Society site are undertaken.
  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

  4. Top PUBLIC FORUM

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

    The following requests have been received to address the meeting:

    4.1. TANYA BATT - NETWORK OF FAIRYTALE VILLAGES AROUND THE WORLD

    Tanya Batt will be in attendance to address the Waiheke Community Board on the Network Of Fairytale Villages Around The World project.

    4.2. LAUREN MASER - 'FIX AUCKLAND'  

    Lauren Maser will be in attendance to address the Waiheke Community Board on the need for separate representation and a specific Waiheke Community Board within the proposed 'One Auckland' council.

  5. Top POLICE ACT REVIEW - PRESENTATION FROM SENIOR SERGEANT BEN OFFNER, NEW ZEALAND POLICE

    Recommending that the Waiheke Community Board recommends to the Arts, Culture and Recreation Committee the granting of a new lease to Otherworld Productions Incorporated for the old Blackpool School Library Building, Nikau Road, Blackpool Park, Waiheke, on the following terms and conditions:

    1. Term - 5 years commencing 1 May 2007
    2. Rights of Renewal - Two rights of renewal each of five years
    3. Rent - $500.00 plus GST per annum
    4. Maintenance and Utilities (outgoings) costs on a per square meter basis
    5. Insurance - All contents insurance including public liability
    6. All other terms and conditions as per Councils Community and Recreation Lease Policy.

  13. Top REQUEST FOR ESTABLISHMENT OF LIQUOR BANS ON WAIHEKE ISLAND

    Reporting on the request of the Waiheke Community Board seeking the establishment liquor bans on all beaches, reserves and other appropriate public spaces on Waiheke Island.

    At its meeting held on 12 July 2007, the Planning and Regulatory Committee resolved as follows:

    "That the Waiheke community board's resolutions regarding the establishment of liquor bans on Waiheke Island beaches be referred to officers for inclusion in their report on interim alcohol bans to the committee's August 2007 meeting"

    Recommending that the resolutions of the Planning and Regulatory Committee, dated 12 July 2007, be received, noting that this matter will be reported back to the Waiheke Community Board September meeting.

  14. Top RURAL AND HAURAKI GULF RATING ISSUES

    Providing the report and resolutions from the Combined Committees meeting held on 21 June 2007 which outlined rating policies for a 100% rates remission on QEII covenanted land, a rate postponement of 25% for commercial farmland over 12 hectares and a rates postponement for Great Barrier Island commercial properties, noting that these policies were supported by submissions to the draft 2007/2008 annual plan.

    The Combined Committees resolved as follows:

    "That it be a recommendation to Council:

    That the following policies that were consulted on in the draft 2007/2008 Annual Plan be adopted as follows:

    1. A remission policy for private land voluntarily covenanted under the QEII National Trust Act (a 100% remission for the covenanted portion of land).
    2. A postponement policy for commercial farmland (a postponement of 25% of the rates for farms over 12 hectares that are GST registered - written off after five years if the property use remains the same).
    3. A postponement policy for Great Barrier Island commercial properties (on the difference between the rates based on rateable value and the rates based on 80% of annual rental - written off after five years if property use remains the same)."

    Recommending that the report and resolutions from the Combined Committees meeting, dated 12 July 2007, be received.

  15. Top ACTIVE AUCKLAND - AUCKLAND CITY COUNCIL'S RECREATION PLAN

    Providing the report and minutes from the Arts Culture and Recreation Committee held on 9 July 2007 advising the development of Active Auckland, which has been developed to provide a clear framework for the council's involvement in sport and physical activity in Auckland. The plan identifies four goals that the council will focus its efforts on and includes 45 action points to implement over the next ten years.

    At its meeting held on 9 July 2007, the Arts, Culture and Recreation Committee resolved as follows:

    1. "That the Arts, Culture and Recreation Committee adopt the Active Auckland plan as the council's recreation plan addressing sport and physical activity in Auckland City, through four key goals:
      1. Opportunities to be active - a variety of opportunities to be active are available and coordinated for the diverse needs and interests of Aucklanders;
      2. Places to be active - a range of places to be active in Auckland are accessible and responsive to changing trends;
      3. Encouraging people to be active - Aucklanders are aware of and able to access opportunities to be active and are motivated to participate;
      4. Working together to be active - recreation organisations in Auckland are robust and working together in a coordinated manner.
    2. That the Arts, Culture and Recreation Committee acknowledge and commend council staff for their work on the Active Auckland plan, and recognise the benefits it will provide."

    Recommending that the report and the resolutions of the Arts, Culture and Recreation Committee, dated 9 July 2007, be received.

  16. Top RAKINO WHARF BUILDING

Advising that no decision will be taken to demolish all or part of the building without the formal involvement of the Waiheke Community Board.

    Recommending that the memorandum from the General Manager, Arts Community and Recreation, dated 18 July 2007, be received, noting that a meeting will be scheduled with officers, Councillor Storer, Councillor Armstrong and the Chairperson to discuss this project further.

    The public conduct of the part of the meeting would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    To enable the Council to carry on, without prejudice or disadvantage, negotiations (including commercial and industrial negotiations).

    In particular the Council would be disadvantaged by price if information was released.
