DECLARATIONS OF CONFLICT OF INTEREST

Elected Representatives are reminded of their obligation to maintain a clear separation between their personal interests and their duties as an elected member of the Council.

Members should therefore be vigilant to stand aside from decision making when a conflict (or a perceived conflict) arises between their role as an elected representative and any private or other external ( either pecuniary or non-pecuniary ) interest they may have.

Any such interests should be declared at the commencement of consideration of any such item on this agenda and the member concerned abstain from voting or discussion on the item, or leave the room for the duration of its consideration.

  2. Top CONFIRMATION OF MINUTES

    The minutes of the Western Bays Community Board meeting held on Wednesday, 23 February 2010 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-
    (a) The local authority by resolution so decides; and
    (b) The presiding member explains at the meeting at a time when it is open to the public,-
      (i) The reason why the item is not on the agenda; and
      (ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting."
    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
    "Where an item is not on the agenda for a meeting,-
    (a) That item may be discussed at that meeting if-
      (i) That item is a minor matter relating to the general business of the local authority; and
      (ii) The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but
    (b) no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."
  4. Top PUBLIC FORUM

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

    The following requests have been received to address the meeting:

    4.1. DISCRETIONARY FUNDING APPLICATION - AUCKLAND CENTRAL YOUTH DEVELOPMENT TRUST PROJECT K

    A representative from the Auckland Central Youth Development Trust - Project K will speak in support of the Trust's discretionary funding application.

    4.2. DISCRETIONARY FUNDING APPLICATION - POMPALLIER TENNIS CLUB  

    A representative from the Pompallier Tennis Club will speak in support of the Club's discretionary funding application.

    4.3. DISCRETIONARY FUNDING APPLICATION - PONSONBY COMMUNITY CENTRE INCORPORATED

    A representative from the Ponsonby Community Centre Incorporated will speak in support of the Centre's discretionary funding application.

    4.4. DISCRETIONARY FUNDING APPLICATION - PASADENA INTERMEDIATE SCHOOL

    A representative from the Pasadena Intermediate School will speak in support of the School's discretionary funding application.

    4.5. POSTER BOLLARDS

    Jamey Holloway, General Manager and Garry Moore of Phantom Billstickers Limited will speak about the benefits of having bollards for posters to be displayed in the Western Bays ward.

  5. Top AMENDMENT OF THE SIGNS BYLAW 2007 - REAL ESTATE SIGNS AND POSTER BOARDS

    Outlining the proposal of the Auckland City Council to amend the clauses of the Signs Bylaw 2007 that relates to poster boards and real estate arising from the council resolution of 22 October 2009.

    The Western Bays Community Board is given an opportunity to provide a written submission to the bylaw hearings panel before 6 April 2010 regarding the following:

    • the proposed amendments contained in the Auckland City Council Signs Amendment Bylaw No 2 of 2009 relating to real estate signs;
    • the proposed amendments contained in the Auckland City Council Signs Amendment Bylaw No 3 of 2009 relating to poster boards.

    Recommending that the Board considers the report.

  6. Top IMPLEMENTATION OF THE SIGNS BYLAW FOR PUBLIC POSTER SITES

    Outlining options that community boards may like to consider for the approval of public poster sites in their wards and the most effective way of managing them.

    Recommending that the Board determine the need for public poster bollards in the Western Bays ward and identify suitable locations by 16 April 2010.

    Also recommending that if poster sites are to be established, the Western Bays Community Board provides input to the Arts, Community and Recreation and Auckland City Environments groups on the following by 30 April 2010 on the following:

    1. the design criteria and type of bollard;
    2. the assessment and approval process to be adopted;
    3. the standard service agreement/contract document for the management of the poster sites.

  7. Top SMALL LOCAL IMPROVEMENT PROJECTS (SLIPS) DECISIONS

    The report was not ready when the agenda went to print. The report will be circulated prior to the meeting.

  8. Top DRAFT ANNUAL PLAN 2010 - 2011

  10. Top DRAFT FUTURE PLANNING FRAMEWORK - PT CHEVALIER-WESTERN PRECINCT PLANS

    As part of the Future Planning Framework (FPF) phase two programme, a draft precinct plan for Point Chevalier/Western Springs has been prepared in collaboration with the community and business stakeholders. The first draft of the precinct plan will be presented for public feedback at public open days of 12 and 13 March 2010.

    The draft of the precinct plan that will be presented at the public open days is also available to view on our website It's my backyard.

    The Western Bays Community Board is requested to consider whether it wishes to provide a submission on the draft precinct plan. The details for submissions are outlined as follows:

    • closing date for submissions is 5.00pm, Friday 19 March 2010
    • submissions can be made:
      • on either of the public open days at the venue; we will provide hard copies of the form for people to fill out and submit at the venue; or
      • take the form home and freepost to Auckland City Council, Future Planning Framework, Private Bag 92516, Wellesley Street, Auckland 1141
      • through the submission form on our website It's my backyard.
      • by emailing the completed form.
