AMENDMENT - KITCHENER GROUP LIMITED APPEAL - PLAN CHANGE 1 CENTRAL AREA DISTRICT PLAN
That the Manager, Central Area Planning, be authorised to proceed with drafting
a consent order to settle appeal ENV-2007-AKL-000400 Kitchener Group Limited v
Auckland City Council that involves amendments to Quarter Plan E, which
identifies the building platform heights on the Victoria Park Market site, a
change to the activity table to make lightweight shelters on new buildings a
restricted discretionary activity, and the introduction of additional assessment
criteria to ensure the redevelopment of the site responds, and is sympathetic,
to the existing scheduled heritage buildings.

disclosure of information for which good reason to withhold exists under

Section 7(2)(i)
The withholding of the information is
necessary to enable the local authority to carry on, without prejudice
or disadvantage, negotiations (including commercial and industrial
negotiations).
In particular, an appeal has been lodged with
the environment court against council decision to construct a new mixed
used building and disclosure of information at this stage could be used
by other parties to gain improper advantage prior to court proceedings. |
