    The minutes of the Planning Fixtures Sub-Committee meeting held on Tuesday, 27 November 2007 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-
    (a) The local authority by resolution so decides; and
    (b) The presiding member explains at the meeting at a time when it is open to the public,-
      (i) The reason why the item is not on the agenda; and
      (ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting."
    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
    "Where an item is not on the agenda for a meeting,-
    (a) That item may be discussed at that meeting if-
      (i) That item is a minor matter relating to the general business of the local authority; and
      (ii) The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but
    (b) no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."
  4. Top SIGNS BYLAW APPLICATIONS

    NOTE - The sign dispensation applications shown as Items 4.1 - 4.5 below have been submitted following a project to enforce sign bylaws in Mount Albert, Point Chevalier, Avondale and Owairaka. As reported to the Sub-Committee on 13 November 2007, the reports include details of the signage and the relevant bylaw provisions but, in accordance with the agreed process, do not include recommendations.

    Application for a dispensation from Part 27 (Signs 2007) of the Auckland City Council Consolidated Bylaw to retain a freestanding sign positioned beside the road reserve at 953 New North Road, Mount Albert. The sign relates to a business located on the site, called Transcontinental Limited. The sign is on a large 2387mē Mixed Use zoned site that contains a range of retail activities and is opposite properties zoned Residential 6b. The sign is 3.3m in height and 1.8m in width, with a total area of 5.94mē.

    Section 93/94 determination and Resource Consent determination on an application to construct five apartment blocks containing 314 residential units in the Residential 8b zone at 160 College Road, St Johns (Mount Wellington Quarry).

    This application was deferred at the meeting of 27 November 2007 for further consideration by the Sub-Committee and for officers to develop further potential proposed conditions of consent.

    Please refer to the Sub-Committee's agenda of 27 November 2007 for a copy of the original report (marked as Item 5.2). The commissioners and officers attending the meeting are asked to bring the report, as previously circulated with the agenda of 27 November, to the meeting. A copy of the report can also be viewed on the council's website.

    Revised proposed conditions of consent are currently being prepared and will be sent out to the Sub-Committee before the meeting.

    Recommending that the application be processed without notice and granted consent, subject to conditions.

    5.2. TIVERTON ROAD/WOLVERTON STREET ROAD WIDENING PROJECT, BLOCKHOUSE BAY 20060343202

    The general subject of each matter to be considered while the public is excluded, the reason for passing this resolution in relation to each matter, and the specific grounds under Section 48(1) of the Local Government Official Information and Meetings Act 1987 for the passing of this resolution follows.

    This resolution is made in reliance on Section 48(1)(a) of the Local Government Official Information and Meetings Act 1987 and the particular interest or interests protected by section 6 or section 7 of that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public, as follows:
