minutes of the Regional Governance Committee meeting held on Thursday, 14 May
2009 to be confirmed as a true and correct record.
EXTRAORDINARY BUSINESS

Section 46A(7) of the Local Government Official Information and Meetings
Act 1987 (as amended) states: |
|
"An item that is not on the agenda for a meeting may be dealt with at
that meeting if- |
|
(a) |
The local authority by resolution so decides; and |
|
(b) |
The presiding member explains at the meeting at a time when it is open
to the public,- |
|
|
(i) |
The reason why the item is not on the agenda; and |
|
|
(ii) |
The reason why the discussion of the item cannot be delayed until a
subsequent meeting." |

Section 46A(7A) of the Local Government Official Information and
Meetings Act 1987 (as amended) states: |

"Where an item is not on the agenda for a meeting,- |
|
(a) |
That item may be discussed at that meeting if- |
|
|
(i) |
That item is a minor matter relating to the general business of the
local authority; and |
|
|
(ii) |
The presiding member explains at the beginning of the meeting, at a time
when it is open to the public, that the item will be discussed at the
meeting; but |
|
(b) |
no resolution, decision, or recommendation may be made in respect of
that item except to refer that item to a subsequent meeting of the local
authority for further discussion." |
PUBLIC FORUM
A
period of time (approximately 20 minutes) is set aside for members of the public
to address the meeting on matters within its delegated authority. A maximum of
5 minutes per item is allowed, following which there may be questions from
members.

SUBMISSION ON LOCAL GOVERNMENT (AUCKLAND COUNCIL) BILL

Reporting on Auckland City Council's submission on the Local Government
(Auckland Council) Bill and providing a brief update on other issues related to
transition to the Auckland Council.
The
Local Government (Auckland Council) Bill ("the Bill") was introduced into
Parliament on 13 May 2009. This Bill:
- provides the high level
framework for the structure of the Auckland Council - eight members elected at
large and 12 members from wards, and 20-30 local boards including their high
level functions;
- empowers the Local
Government Commission (LGC) to determine the boundaries of the wards of the
Auckland Council and the local boards, and the number of boards and their
membership;
- provides for the
integration of Auckland's water and wastewater services; and
- provides for the mayor
to promote a vision for Auckland, develop proposals for the draft long-term
council community plan and draft annual plan, appoint the deputy mayor and
chairperson of each committee of council and establish a mayoral office.
The
Bill has been referred to the Auckland Governance Legislation Committee (the
Select Committee), established specifically to consider legislation on
Auckland's local government reorganisation. Submissions close on 26 June 2009.
Proposed policy positions have been developed after a recent briefing with
councillors, for inclusion in council's submission. These are set out in the
report. A draft submission is being prepared and will be circulated to
councillors on Friday 19 June 2009.
The
Auckland Transition Agency (ATA) has now been appointed by Government. The ATA
is in the process of establishing its team, engaging consultants, and
establishing its work programme. A key focus for the ATA is the development of a
process for the confirmation of council decisions, including confirming the
LTCCP.
Recommending that the Regional Governance Committee recommends to council
Auckland City Council's submission on the Local Government (Auckland Council)
Bill based on policy positions identified in the report, that a working party of
the Committee be delegated to finalise the wording of the submission and that
His Worship the Mayor, the Deputy Mayor and the chief executive be delegated to
represent council at the hearings of the Auckland Governance Legislation
Committee.
