EXTRAORDINARY BUSINESS

Section 46A(7) of the Local Government Official Information and Meetings
Act 1987 (as amended) states: |
|
"An item that is not on the agenda for a meeting may be dealt with at
that meeting if- |
|
(a) |
The local authority by resolution so decides; and |
|
(b) |
The presiding member explains at the meeting at a time when it is open
to the public,- |
|
|
(i) |
The reason why the item is not on the agenda; and |
|
|
(ii) |
The reason why the discussion of the item cannot be delayed until a
subsequent meeting." |

Section 46A(7A) of the Local Government Official Information and
Meetings Act 1987 (as amended) states: |

"Where an item is not on the agenda for a meeting,- |
|
(a) |
That item may be discussed at that meeting if- |
|
|
(i) |
That item is a minor matter relating to the general business of the
local authority; and |
|
|
(ii) |
The presiding member explains at the beginning of the meeting, at a time
when it is open to the public, that the item will be discussed at the
meeting; but |
|
(b) |
no resolution, decision, or recommendation may be made in respect of
that item except to refer that item to a subsequent meeting of the local
authority for further discussion." |
PUBLIC FORUM
A
period of time (approximately 20 minutes) is set aside for members of the public
to address the meeting on matters within its delegated authority. A maximum of
5 minutes per item is allowed, following which there may be questions from
members.

61-73 DAVIS CRESCENT, NEWMARKET - HEARING OF OBJECTION TO NOTICE TO INSTALL STORMWATER DRAINS

Following consideration of this matter at its September 2008 meeting, the
Specialist Hearings sub-committee resolved to defer the item until its 7 October
meeting pending the provision of additional information from Council regarding
the feasibility and practicality of an alternative route for the public
stormwater pipeline proposed beneath 61-73 Davis Crescent, Newmarket.
At
its 7 October meeting, the sub-committee agreed that the matter be deferred
until this meeting to enable the objector to provide specific written concerns
relating to the property at 61-73 Davis Crescent if the deep tunnel option was
to proceed, and a written response to the engineering and traffic assessment
prepared by the Council.
Attached is the report provided to the sub-committee's 7 October meeting,
together with a response from Traffic Planning Consultants Ltd dated 20 October
2008 to the engineering and traffic assessments.
Recommending that the sub-committee determines whether to abandon the works
proposed, or to proceed therewith with or without such alteration as it thinks
fit.
