MINUTES OF A MEETING OF THE
SPECIALIST HEARINGS SUB-COMMITTEE

    1A. APPOINTMENT OF CHAIRPERSON

    That Mr Conway Stewart be appointed as the chairperson for this meeting.

    That the minutes of the Specialist Hearings sub-committee meeting held on Tuesday, 1 July 2008, be confirmed as a true and correct record.

    There was no extraordinary business.

    There was no public forum.

  5. Top 136 WAIPUNA ROAD EAST - HEARING OF OBJECTION TO NOTICE TO INSTALL STORMWATER DRAINS

    Mr Brian Burton, representing the Trustees of Agricorp International Ltd, spoke to his tabled submission. He also advised that he was speaking on behalf of the other submitters.

    1. That pursuant to section 48.2(a)(i) of the Local Government Official Information and Meetings Act 1987, the public be excluded from the deliberations of the Specialist Hearings sub-committee following the hearing of evidence in this matter, for the reason that a right of appeal lies to the District Court against the final decision of the sub-committee.

    CARRIED

    1. That after hearing the tabled submission of Mr Burton on behalf of Agricorp International Ltd and the other submitters, the Specialist Hearings sub-committee determines that the works to construct a larger diameter (225mm) new public stormwater line from 136 Waipuna Road through 130, 128 and 126 Waipuna Road to the existing manhole (NN2427) in number 124 Waipuna Road may proceed for the reason that this is the most practical solution to provide enhanced public stormwater infrastructure and, in particular, to 124, 126, 126A, 128, 128A, 130, 134 and 136 Waipuna Road East.
    2. That the main pipe be installed by trenchless methods and not by open cut trenching, unless it is demonstrated to the satisfaction of the Manager, Environmental and Utility Management that it is impractical due to existing soil conditions.
    3. That the private stormwater drainage from both 134 and 136 Waipuna Road East be connected to the proposed new manhole at 136 Waipuna Road East.
    4. That any disturbance to any property shall be reinstated.
    5. That the Specialist Hearings sub-committee notes that a right of appeal to the District Court applies to this decision within fourteen days of the date of the sub-committee's determination.
    6. That all other necessary consents and permits shall be obtained, including those under the Resource Management Act 1991 and the Building Act 2004, and shall comply with all relevant Council bylaws.

    There being no further business, the chairperson declared the meeting closed at 11.00 am.
