CONFIRMATION OF MINUTES
That
the minutes of the Transport Committee meeting held on Thursday, 12 March 2009
and the minutes of the extraordinary Transport Committee meeting held on
Wednesday, 25 March 2009 to be confirmed as true and correct records.
EXTRAORDINARY BUSINESS
| Section 46A(7) of the Local Government Official Information and Meetings
Act 1987 (as amended) states: |
| "An item that is not on the agenda for a meeting may be dealt with at
that meeting if- |
| (a) |
The local authority by resolution so decides; and |
| (b) |
The presiding member explains at the meeting at a time when it is open
to the public,- |
| |
(i) |
The reason why the item is not on the agenda; and |
| |
(ii) |
The reason why the discussion of the item cannot be delayed until a
subsequent meeting." |
| Section 46A(7A) of the Local Government Official Information and
Meetings Act 1987 (as amended) states: |
| "Where an item is not on the agenda for a meeting,- |
| (a) |
That item may be discussed at that meeting if- |

(i) |
That item is a minor matter relating to the general business of the
local authority; and |

The presiding member explains at the beginning of the meeting, at a time
when it is open to the public, that the item will be discussed at the
meeting; but |

no resolution, decision, or recommendation may be made in respect of
that item except to refer that item to a subsequent meeting of the local

PUBLIC FORUM
A
period of time (approximately 20 minutes) is set aside for members of the public
to address the meeting on matters within its delegated authority. A maximum of
5 minutes per item is allowed, following which there may be questions from
members.

ROAD LEGALISATION AND LAND EXCHANGE SHOAL BAY ROAD GREAT BARRIER ISLAND

The
road on the intersection of Shoal Bay and Medland Roads has been formed over
private land. The landowner has agreed to transfer the ownership of the land to
council in return for two sections of unformed road which adjoin his property.
Council will undertake to pay for all costs associated with the land exchange.
There is no other adjoining landowner affected by the road stopping so the
exchange can be carried out under the Public Works Act 1981.
Recommending that the land exchange be considered.

ROAD STOPPING MORTON STREET, AUCKLAND CENTRAL

The
landowner at 75 Cook Street, Auckland Central is seeking to stop and purchase
approximately 39 square meters of road which inverts into his property. The land
is not required by council for future roading or any other purpose. The current
adjoining landowner has undertaken to pay for all the road stopping costs and
will be paying council for the full market value of the land. The road stopping
is proposed to be carried out under the Public Works Act 1981.
Recommending that the road stopping be considered.
