  2. Top CONFIRMATION OF MINUTES

    That the minutes of the Transport Committee meeting held on Thursday, 12 March 2009 and the minutes of the extraordinary Transport Committee meeting held on Wednesday, 25 March 2009 to be confirmed as true and correct records.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-
    (a) The local authority by resolution so decides; and
    (b) The presiding member explains at the meeting at a time when it is open to the public,-
      (i) The reason why the item is not on the agenda; and
      (ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting."
    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
    "Where an item is not on the agenda for a meeting,-
    (a) That item may be discussed at that meeting if-
      (i) That item is a minor matter relating to the general business of the local authority; and
      (ii) The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but
    (b) no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."
  4. Top PUBLIC FORUM

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

  6. Top SUPPLIER RECOMMENDATION REPORT FOR TEN ASSET MAINTENANCE AND RENEWAL TERM CONTRACTS, STREET LIGHTING DESIGN AND PLANNING

    The following resolutions were passed at the council meeting on 26 March 2009:

    That the Transport Committee Report No. 1/2009 be adopted as amended, i.e.:

    Supplier recommendation report for 10 Asset Maintenance and Renewal Term Contracts, Street Lighting Design and Planning

    1. That in order to allow the Transport Committee the opportunity to familiarise itself with material presented and to ensure probity, the awarding of the following contracts be deferred to a meeting of the Transport Committee (if necessary a special meeting be called).

    1. That the council delegates authority to approve the awarding of contracts listed in resolution A above to the Transport Committee in order for the contracts to be implemented on 1 July 2009.
    2. That the council defer making a decision on the following contracts until the 23 April 2009 council meeting:

  8. Top ROAD LEGALISATION AND LAND EXCHANGE SHOAL BAY ROAD GREAT BARRIER ISLAND

    The road on the intersection of Shoal Bay and Medland Roads has been formed over private land. The landowner has agreed to transfer the ownership of the land to council in return for two sections of unformed road which adjoin his property. Council will undertake to pay for all costs associated with the land exchange. There is no other adjoining landowner affected by the road stopping so the exchange can be carried out under the Public Works Act 1981.

    Recommending that the land exchange be considered.

  9. Top ROAD STOPPING MORTON STREET, AUCKLAND CENTRAL

    The landowner at 75 Cook Street, Auckland Central is seeking to stop and purchase approximately 39 square meters of road which inverts into his property. The land is not required by council for future roading or any other purpose. The current adjoining landowner has undertaken to pay for all the road stopping costs and will be paying council for the full market value of the land. The road stopping is proposed to be carried out under the Public Works Act 1981.  

    Recommending that the road stopping be considered.

  14. Top EXCLUSION OF THE PUBLIC: LOCAL GOVERNMENT OFFICIAL INFORMATION AND MEETINGS ACT 1987

    That the public be excluded from the following part(s) of the proceedings of this meeting.

    The general subject of each matter to be considered while the public is excluded, the reason for passing this resolution in relation to each matter, and the specific grounds under Section 48(1) of the Local Government Official Information and Meetings Act 1987 for the passing of this resolution follows.

    This resolution is made in reliance on Section 48(1)(a) of the Local Government Official Information and Meetings Act 1987 and the particular interest or interests protected by section 6 or section 7 of that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public, as follows:

    The text of these resolutions is made available to the public who are present at the meeting and form part of the minutes of the meeting.

    C1. Review Of The Parking Advisory Board's Performance For The Second Quarter 2008/2009 Public conduct of matter would be likely to result in disclosure of information for which good reason to withhold exists under section 7. Section 7(2)(h)

    The withholding of the information is necessary to enable the local authority to carry out, without prejudice or disadvantage, commercial activities.

    In particular, the report contains material that in a competitive environment, competing with privately owned car parks, and disclosure of strategic intent could have an adverse impact on the market.

    Section 48(1)(a)

    The public conduct of the part of the meeting would be likely to result in the disclosure of information for which good reason for withholding exists under section 7.
