    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    Lot 1 infringes the permitted maximum impermeable surfaces coverage. The proposed subdivision will also result in an infringement to the maximum permitted gradient for the existing access to serve Lots 1 & 2 and the grade of the parking and manoeuvring for Lot 1.

    This application was deferred at the Committee's meeting of 10 July 2007 in order to seek written confirmation from the Council's Engineers regarding all matters relating to stormwater and overland flows on the site and downstream. This report is attached at pages A-B.

    6.1. CARLAW PARK, PARNELL 20070327201

    Appointment of Planning Commissioner(s) to hear and determine an application to construct a retirement village on lot 2 of Carlaw Park, Parnell.

    The Committee previously appointed planning commissioners to hear and determine two applications for Carlaw Park. One application is pending close of submissions for a limited notified application. The second application, relating to the retirement village, was withdrawn. A modified application, still involving a retirement village has been submitted.

    It is recommended that, in order to be consistent, the same commissioners be appointed for this application.

    21 Reimers Avenue Mt Eden - Environment Court Appeal

    The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2) (j) - The withholding of the information is necessary to prevent the disclosure or use of official information for improper gain or improper advantage.

    In particular, a majority decision has been made by the Environment Court in support of the Council's decision to refuse consent to the construction of a second residential unit at the rear of an existing villa in the Residential 1 zone. The appellant has 15 working days to appeal this decision to the High Court. The disclosure of information at this stage could be used by other parties to gain improper advantage prior to court proceedings.

    S48(1)(a): The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.
