    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    Resource Consent determination on an application to construct a concrete driveway of 225 metres in length, together with retaining walls and jetty abutment at 60 Sandford Way, Rakino Island.

    This application was jointly notified with the Auckland Regional Council (ARC). The hearing was cancelled as the submitter in opposition withdrew their submission. The attached agenda report was prepared for the full hearing and includes comments regarding the submissions. The ARC granted consent for the jetty, boat ramp and moorings on 10 July 2007.

    The one submitter to Auckland City Council did not wish to be heard. The issues raised by the submitter have been addressed within the report.

    Recommending that the application be granted consent, subject to conditions.

    Land use consent was granted in December 2006 to undertake alterations and additions to an existing residential dwelling on the subject site. The applicant wishes to amend condition (1) of this previous consent as a survey has revealed that the master bedroom addition has been constructed 330 millimetres closer to the northeastern/rear boundary. In addition, the pitch of the roof on the addition has been amended from a gable to a hip and the depth of the eave has been reduced.

These are existing freestanding signs which need to be relocated as Great South Road is widened to accommodate an additional traffic lane. Most of the subject signs have been subject to previous applications for dispensation.

    Appointment of Planning Commissioner(s) to hear and determine an application to erect a building on the site at 29-31 Eden Crescent, Auckland Central. The building will be used for residential accommodation, with a provision for a restaurant or café at ground level.

    A resource consent was granted on a non-notified basis in August 2006. The Official Bay Heritage Protection Society sought a judicial review of the Council's decision not to notify the application. In July, the Court rejected the Society's claims and the Society is currently appealing that decision.

    The applicant now seeks a second 'back up' consent for an effectively identical development. This is normal procedure where an initial consent is challenged and delayed for lengthy periods in the Courts.

    The original application was considered by Mr R Gee, Mr J Hill, Mr R Wright (deceased), Ms L McGregor and Cr F Storer. The applicant has requested that as many as possible of the original Commissioners be appointed as they are familiar with the development.

    380 Cowes Bay Road, Waiheke Island - Environment Court Appeal

    The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2) (j) - The withholding of the information is necessary to prevent the disclosure or use of official information for improper gain or improper advantage.

    In particular, an appeal has been lodged with the Environment Court against the Council's decision to approve land use consent for vehicle access, including the removal of native vegetation, site works and driveway gradient greater than 1:4 to a proposed jetty and boat ramp within the Coastal Marine Area at 380 Cowes Bay Road, Waiheke Island. The disclosure of information at this stage could be used by other parties to gain improper advantage prior to court proceedings.

    S48(1)(a): The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.
