    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

    Transit New Zealand, as requiring authority for designation referenced A07-01 (being the generic reference for "motorway" in the isthmus) has served a notice of requirement for alteration to this designation. The alteration relates to an extension of this designation boundary alongside the northern side of the approach to the Mangere motorway bridge.

    The alteration involves land owned by Transit New Zealand and is a gazetted motorway. Where the tests under section 181(3) are met, a designation may be altered at any time. These tests have been met in this case.

    Recommending that:

    1. the council agrees to alter designation A07-01 by including an additional 940m² area of land currently zoned Regional Arterial Road as identified in the Transit New Zealand notice of requirement dated 3 August 2007, pursuant to section 181(3) of the Resource Management Act 1991
    2. district plan map H10 (Map 2) be amended to reflect the alteration in (a) above.

    A joint hearings panel made recommendations on 45 Auckland City Council submissions, which were subsequently adopted by the Auckland Regional Council. Having reviewed the decision of the Regional Council, staff have identified four submissions which have not been given adequate relief.

    The report recommends that the committee authorises staff to proceed with an appeal to the Environment Court with regard to the decision of the Auckland Regional Council - Proposed Change 6, Giving Effect to the Regional Growth Concept and Integrating Landuse and Transport.

  11. Top ROAD OUTSIDE 3 SHAW STREET, KINGSLAND - URGENT DECISION FOR APPOINTMENT OF INDEPENDENT PLANNING COMMISSIONERS

    The Chairman of the Planning Fixtures Committee was required to take an urgent decision to appoint independent planning commissioners to hear and determine an application to remove two generally protected Silver Birch trees located within the road outside 3 Shaw Street, Kingsland. This decision was taken on 24 September 2007. The reason for urgency was the need to arrange a hearing as soon as possible because of the health issues of the occupants and the next committee meeting was not until 2 October 2007.

    The decision is attached for the committee's information.

    "Jenny's" Road, Tryphena, Great Barrier Island - Environment Court Appeal

    The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2) (j) - The withholding of the information is necessary to prevent the disclosure or use of official information for improper gain or improper advantage.

    In particular, an appeal has been lodged with the Environment Court against the council's decision to approve land use consent to undertake roading works to form part of the legal 'paper' road commonly known as "Jenny's" Road at Tryphena. The disclosure of information at this stage could be used by other parties to gain improper advantage prior to court proceedings.

    S48(1)(a): The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.
