    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    At its meeting on 10 July 2007, the Planning Fixtures Committee appointed three Planning Commissioners to hear and determine an application to carry out a four lot subdivision to create three new titles on Hector Sanderson and Gray Roads, Great Barrier Island. The applicant's agent has requested that the number of commissioners appointed be reduced from three to one. As the subdivision is proposed both around existing and proposed residential sites, and involves retrospective and proposed land use consents, the planning officer is recommending that multiple commissioners would be appropriate in this case.

    The Planning Fixtures Committee has appointed commissioners to sit on a number of hearings that have yet to have hearings dates set. In many instances the commissioners appointed are elected representatives, who, from midnight, Friday 12 October 2007, do not have delegation to sit on hearings.

    It is requested that the sub-committee resolves to make a general appointment of commissioners to cover any of these instances as they arise. It is suggested that the number of commissioners remains the same as appointed by the Planning Fixtures Committee.

  7. Top TEMPORARY LIQUOR BANS FOR THE 2007-2008 YEAR

    This Sub-Committee currently has the power to make decisions regarding adoption of liquor bans, a power which was previous delegated to the Planning and Regulatory Committee (Council decision: 23 August 2007).

    The attached report shows temporary liquor bans requested for the 2007-2008 year. All proposed bans have either been endorsed by or requested by the Police.

    Recommending that the liquor bans detailed in the report be approved.

    The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2) (j) - The withholding of the information is necessary to prevent the disclosure or use of official information for improper gain or improper advantage.

    In particular, an appeal has been lodged with the Environment Court against the council's decision to decline a land use consent application for a new dwelling in Land Unit 20 that exceeded lot coverage and infringed the maximum height control in respect of a ridgeline.

    The disclosure of information at this stage could be used by other parties to gain improper advantage prior to court proceedings.

    S48(1)(a): The public conduct of this matter would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.
