Plan declared operative in part.
Recommending that subject to the Environment Court granting consent under

Council approves the Proposed Central Area Section of the District Plan being
made operative except in relation to the following provisions:
- Part 14.6 Britomart Precinct which is subject to Variation 30
- Part 14.9 Western Reclamation Precinct
- Part 14.10 Victoria Park markets Precinct
- The scheduled items in the Victoria Park Market Precinct with the
reference numbers 178, 355, 356, 357 and 358

Attaching a report on an application made by the Eden Park Trust Board to
erect a pedestrian overbridge from the Kingsland Rail Station to Walters Road.
This overbridge is designed to deal with significant volumes of pedestrians
accessing Eden Park for events, and will eventually continue on into the park
itself.
Recommending that the committee grant an air space licence to the Eden Park
Trust Board to construct an overbridge across Sandringham Road linking Walters
Road and Kingsland Station subject to the conditions listed in the report of J
Duthie, Group Manager City Planning, dated 23 November 2004.

The following resolution was made by the Great Barrier Community Board at its
meeting held on 21 September 2004, requesting the committee review the recent
increases in environment health license fees as they relate to Great Barrier
Island. Also attaching correspondence received by the Community Board for
committee's information.
That the Board requests that the incoming City Development Committee, or its
equivalent committee urgently review recent increases in environmental health
license fees as they relate to Great Barrier Island, for the following reasons:

(i) the seasonal nature of Great Barrier Island businesses;
|
|
(ii) the inability for businesses to be able to pass on sudden cost
increases;
|
|
(iii) viability of small businesses on Great Barrier Island;
|
|
(iv) inadequate consultation process undertaken; and
|
|
(v) cumulative effect of fee increases and general rate increases for Great
Barrier Island non-residential properties.
|
Recommending that the committee review the recent increases in environment
health license fees as they relate to Great Barrier Island.

bans for special events. The suggested process has been developed in accordance
with Part 14 of the Auckland City Consolidated Bylaw 1998 Liquor Control in

the appropriateness of developing a liquor ban.
Recommending that the committee:
- Adopt the proposed process for temporary liquor bans in accordance with
Part 14 of the Auckland City Consolidated Bylaw 1998, Liquor Control in
Public Places, as outlined in the report of K Hood, Community Planner, dated
23 November 2004.
- That the committee recommend to Council that applications for temporary
liquor bans be delegated to the Planning and Fixtures Committee.

land for assessment of residential financial contributions.
Recommending that the committee note that financial contributions will be
calculated in line with the legal opinions of Simpson Grierson and Buddle
Findlay. This involves the three distinct steps:
- Determining the "site value" based on a registered valuer's
opinion (GST inclusive).
- Calculating the level of financial contribution as per the formula in the
rule in the district plan.
- Imposing the condition requiring a contribution on the holder of the
resource consent and charging the holder that amount plus GST.
