  2. Top CONFIRMATION OF MINUTES

    The minutes of the Planning and Regulatory Committee meeting held on Thursday, 10 February 2005 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

  4. Top PUBLIC FORUM

    A period of time (approximately 20 minutes) is set aside for members of the public to address the Meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

    4.1. STREET TRADING ACTIVITIES IN AUCKLAND CITY

    Harmeet Sehgal will address the committee on issues relating to street trading in Auckland city.

    4.2. NEWMARKET CROSS STREET BANNER TRIAL

    Peter Corner of the Newmarket Business Association will address the committee on issues relating to the Newmarket Cross Street Banner trial.

    4.3. NEWMARKET CROSS STREET BANNER TRIAL – HELEN PENGELLY

    Helen Pengelly of the Newmarket Business Association will address the committee on issues relating to the Newmarket Cross Street Banner trial.

    4.4. DOG BYLAW – DEAN JOSEPH

    Dean Joseph will address the committee on issues relating to the dog control bylaw.

    The Public Safety and Community Order Committee at its meeting held on Monday, 14 February 2005 resolved, inter alia:

    1. That it be a recommendation to the Planning and Regulatory Committee:

    That the Planning and Regulatory Committee consider applying adequate sound proofing controls on apartments in areas where neighbouring licensed premises exist and/or other forms of night time entertainment.

    Recommending that the committee considers applying adequate sound proofing controls on apartments.

    1. That it be recommended to the Planning and Regulatory Committee to initiate the zone changes as set out in the following table:

  8. Top PROPOSED PLAN MODIFICATION 138 – UPLIFTING THE ZONING FROM LAND DECLARED ROAD

    1. That the Western Bays Community Board recommend to the Planning and Regulatory Committee that, as a matter of urgency, a minor amendment be made to Part 5C.7.3.3B of the District Plan (Isthmus Section), to enable more effective protection of trees on roads.

    Recommending that the committee refer to council to endorse the minor amendment to Part 5C.7.3.3B of the District Plan (Isthmus Section).
