    The minutes of the Planning and Regulatory Committee meeting held on Monday, 7 March 2005 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    1. The local authority by resolution so decides; and

    2. The presiding member explains at the meeting at a time when it is open to the public,-

      1. The reason why the item is not on the agenda; and

      2. The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    1. That item may be discussed at that meeting if-

      1. That item is a minor matter relating to the general business of the local authority; and

      2. The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    2. no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

    Attaching a report updating the committee on the horticultural soils issues, placing information on Land Information Memoranda (LIMs) and future testing of residual horticultural soils land. The report also contains updates on progress of the sampling trial as information becomes available.

    Recommending that the report of the Team Leader Environmental Projects, City Planning dated 6 April 2005 be received and that the committee be updated on the progress of the sampling trial as information becomes available.

  7. Top CENTRAL AREA WEST BUS PRIORITY – BYLAW ALTERATION

    Attaching a report scoping sheet outlining the Central Area West bus priority – bylaw alteration, which falls into two areas: section 25.5.5 which lists bus lanes, and section 25.5.8 which lists areas where buses may make special turning movements which are not available to other traffic.

    Recommending that the committee recommend to council that, subject to section 25.5.7 of the Consolidated Bylaw, section 25.5.5 of the Consolidated Bylaw be altered by resolution to include the clauses contained in the report scoping sheet of the Senior Transport Planner dated 24 March 2005.

  8. Top SETTING DOG REGISTRATION AND ANIMAL CONTROL FEES

    Attaching a report listing the dog registration fees for 2004-05. It is anticipated that Auckland city's needs in 2005-06 will remain unchanged, and therefore the dog registration fees and animal control fees can remained at their 2004-05 levels.

    Recommending that the dog registration fees and animal control fees remain at their current levels for the 2005-06 financial year.

  9. Top EXTENDING COUNCIL'S BOUNDARY DOWN TO MEAN LOW WATER

    Attaching a report informing the committee that the boundaries of Auckland city have been extended down to mean low water springs and this has been published by the Local Government (Auckland City) Boundary Alteration Notice 2005 which was gazetted on 24 March 2005.

    Recommending that the gazette notice containing the Auckland City Boundary Alteration Notice be widely distributed to groups in the council and the new boundaries be advertised for public information in the City Scene.

    1. That Councillor Penny Sefuiva be appointed to the Planning and Regulatory Committee and that Councillor Christine Caughey be confirmed as an alternate member to the Hauraki Gulf Forum.

    Recommending that the resolution be received.

  12. Top RESOURCE CONSENT NOTIFICATION

    The Eden/Albert Community Board at its meeting held on 23 March 2005 resolved, inter alia:

    1. That the Planning & Regulatory Committee be requested to investigate the issue of officer delegations of notification and in particular, notification of resource consent applications regarding sites that are sensitive within the ward.
    2. That the Planning & Regulatory Committee be requested to explore the issues of variations of consent which, if submitted in the original application, would have justified a notification of the consent.

    Recommending that officers be requested to investigate and report to the Planning and Regulatory Committee on the issues raised in the report dated 12 March 2005 from Board Member Christopher Dempsey.

  13. Top TEMPORARY ADVERTISING BANNERS ON BUILDING SITES

    Attaching a report on the viability of temporary banner advertising on buildings/construction sites in Auckland city, as requested by the committee based on a presentation made by Ian Robinson of Amity Media at the February meeting of the Planning and Regulatory Committee.

    Recommending:

    that the committee confirms that it is either opposed to the trial as proposed by Amity Media, or

    that the committee grants a dispensation from the signs bylaw and the billboard signs bylaw and approves a two year trial of advertising signs on building sites by Amity Media, commencing 1 May 2005, subject to conditions.
