  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    1. The local authority by resolution so decides; and
    2. The presiding member explains at the meeting at a time when it is open to the public,-
      1. The reason why the item is not on the agenda; and
      2. The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    "Where an item is not on the agenda for a meeting,-

    1. That item may be discussed at that meeting if-
      1. That item is a minor matter relating to the general business of the local authority; and

    2. no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

  7. Top REVIEW OF CURRENT AUCKLAND CITY ALCOHOL BANS

    Reporting on the effectiveness of the eight suburban alcohol bans, which resulted from Council resolution in September 2004, (Avondale, Parnell, Newmarket, Panmure, Otahuhu, Glen Innes, Mission Bay, Onehunga) and the extension of the existing CBD ban to 24 hours a day, seven days a week.

    Recommending :

    1. That no changes are made to the Liquor Control in Public Places Bbylaw, and that no new bans are introduced nor geographical or temporal extensions made to existing bans.
    2. The need for more robust data collection concerning the alcohol bans, including the need for officers to work with police on gathering relevant and consistent information, is referred to the Public Safety and Community Order committee, and that future research on bans include consideration of the social impact of bans, displacement, impact on civil liberties, hotspots, police enforcement and alternatives to bans.

  8. Top PROPOSED FIREWORKS BAN TAMAKI DRIVE

    Reporting on a proposed fireworks ban on areas of open space along Tamaki Drive on Guy Fawkes night, 2005.

    Recommending :

    1. That the committee supports the proposal to ban the letting off of fireworks on open space along Tamaki Drive from Okahu Bay to Achilles Point in 2005 for reasons of public safety (Okahu Bay, Watene Reserve, Whenua Rangatira, MJS Memorial, Orakei Domain, Selwyn Domain, Kohimarama Beach, Vellenoweth Green, St Heliers Bay Beach, Ladies Bay, Achilles Point).
    2. That the Ngati Whatua o Orakei Reserves board be approached for its consent to extend the fireworks ban to the Whenua Rangatira and Okahu Bay.
    3. That the Planning and Regulatory Committee recommends to Council that the fireworks ban be put in place under the provisions of Auckland City Consolidated Bylaw 20.3.1.

  9. Top PROPOSED PRIVATE PLAN CHANGE – CONTAMINATION PROVISIONS AT SYLVIA PARK BUSINESS CENTRE LIMITED

    Updating the committee on the private plan change lodged by Sylvia Park Business Centre Limited to amend their existing concept plan (G14-15) to provide for an exception to the district wide discretionary activity rule for applications to redevelop or use a contaminated site (rule 5E.7.4.1).

    Recommending :

    1. That Sylvia Park Business Centre Limited be advised that the council has accepted the request for a change to the District Plan to address contamination issues and will notify the request as a private plan change.
    2. That the Manager: Isthmus and Islands Resource Management be authorised to commence the necessary statutory procedures for the public notification of the private plan change with a submission period of 20 working days.

  10. Top PLAN CHANGE 144 – NON-COMPLYING STATUS OF ACTIVITIES NOT SPECIFICALLY PROVIDED FOR

    Updating the committee on Plan Change 144 (Non-Complying Status of Activities not Specifically Provided for) and advising that The Environment Court has confirmed that the only appeal lodged to Plan Change 144 has been withdrawn.

    Recommending that the Committee recommend to Council :

    1. That Plan Change 144 (non-complying status of activities not specifically provided for) be approved and incorporated into the Auckland City District Plan: Isthmus Section 1999.
    2. That the Manager: Isthmus and Islands Resource Management be authorised to publicly notify the date on which Plan Change 144 will become operative.

  11. Top APPROVAL OF PLAN CHANGE 39 (HAURAKI GULF MARINE PARK ACT) TO THE HAURAKI GULF ISLANDS DISTRICT PLAN

    Updating the committee on the status of Plan Change 39 – Hauraki Gulf Marine Park Act 2000 which was subject to an appeal to the Environment Court.

    Recommending :

    1. That Plan Change 39 (as amended by the consent order) which introduces changes to ensure the District Plan did not conflict with the objectives of the Hauraki Gulf Marine Park Act 2000, be approved and that the plan change be incorporated into the Auckland City District Plan (Hauraki Gulf Islands section).
    2. That the Manager: Isthmus and Islands Resource Management be authorised to publicly notify the date on which Plan Change 39 will become operative.
