    The minutes of the Planning and Regulatory Committee meeting held on Thursday, 8 September 2005 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    1. The local authority by resolution so decides; and
    2. The presiding member explains at the meeting at a time when it is open to the public,-
      1. The reason why the item is not on the agenda; and
      2. The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    1. That item may be discussed at that meeting if-
      1. That item is a minor matter relating to the general business of the local authority; and
      2. The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but
    2. no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

  8. Top BYLAW ENFORCEMENT AND PROJECTS

    Report updating the committee on steps being undertaken to increase bylaw and District Plan enforcement.

    Recommending that :

    1. That the compliance projects team proceed with the review of enforcement projects as outlined in Appendix A of the report W Adler, Service Requests Manager dated 19 September 2005, and report back to the committee in December 2005 on its programme for the remainder of the 2005/06 financial year.
    2. That options for improving the effectiveness of signs enforcement be considered as part of the current review of the Signs Bylaw (Part 27).

  9. Top ANIMAL CONTROL ENFORCEMENT REPORT

    Providing a summary of the enforcement system for animal control and an assessment of the dog enforcement system which came into effect on 1 September 2004.

    Recommending the investigation of options to enable the dog control officers to work more efficiently, such as through the use of handheld units.

    • adopted pursuant to section 10A of the Dog Control Act 1996
    • publicly notified
    • sent to the Secretary for Local Government within one month of the adoption of the report.

  11. Top SINGLE MEANS OF ESCAPE FROM A HIGH RISE BUILDING

    Providing an overview of the issues faced by Council when considering whether to issue a building consent for a high-rise apartment block that only has one fire escape.

    Recommending the committee endorse Council's use of independent experts and the current determination process for accessing single means of escape from high rise buildings.

  13. Top APPROVAL TO MAKE THE WESTERN RECLAMATION PRECINCT PROVISIONS OF THE PROPOSED CENTRAL AREA SECTION OF THE DISTRICT PLAN OPERATIVE IN PART

    Advising the committee of the Environment Court's approval of Council's application to make a further part of the Central Area Plan operation, being Part 14.9 Western Reclamation Precinct.

    Recommending that the committee recommends to full Council :

    1. In accordance with the Environment Court consent dated 1 September 2005 under clause 17(2) of the First Schedule of the Resource Management Act 1991 the Council approves Part 14.9 Western Reclamation Precinct of the Proposed Central Area Section of the District Plan being made operative except in relation to the following provisions:
      1. The parking ratio for office activities and
      2. The provisions for the area of land known as the Halsey Street reclamation.
    2. Part 14.9 Western Reclamation Precinct of the Proposed Central Area Section of the District Plan shall become operative in part at midday on 14 November 2005.

  14. Top PLAN CHANGE 154 – RESIDENTIAL ACTIVITY IN THE BUSINESS 2 & 3 ZONE

    Updating the committee on Plan Modification 154 which introduces new urban design provisions for development of residential units in the business 2 & 3 zone of the Isthmus District Plan following the close of the appeal period.

    Recommending that the committee recommend to full Council :

    1. That Plan Change 154 (introducing new urban design provisions for developments of residential units in the Business 2 & 3 zone) be approved and incorporated into the Auckland City District Plan: Isthmus Section 1999.
    2. That the Manager: Isthmus and Islands Resource Management be authorised to publicly notify the date on which Plan Change 154 will become operative.

  15. Top A NOTIFIED PLAN CHANGE 142 – PANMURE GROWTH AREA STRUCTURE PLAN AND LOCAL VIEW PROTECTION

    The above application was considered by a Hearings Panel consisting of Cr G Fryer, Cr L Boyle, Cr WA Christian and Cr F Storer on 27 July 2005, the panel resolved inter alia as follows.

    1. That the Panel recommends to the Planning and Regulatory Committee that a plan change be developed which provides protection for the W10 viewshaft, to be notified in the event that Regional Policy Statement Plan Change 8 is successful in deleting the viewshaft from the Regional Policy Statement.

    Recommending that officers report back to the committee on the proposed plan change.
