    The minutes of the Planning and Regulatory Committee meeting held on Thursday, 13 July 2006 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

  9. Top EARTHQUAKE-PRONE, DANGEROUS AND INSANITARY BUILDINGS POLICY (FINAL)

    At its meeting on 13 July 2006, the Planning and Regulatory resolved as follows:

    1. That the committee adopt and endorse the recommendations of the working party and approve the Dangerous and Insanitary Buildings policy.
    2. That the committee forward the policy to council for formal adoption.
    3. That the issue of Earthquake-prone buildings be referred back to the Working Party for further consideration and report to the August meeting of the Planning and Regulatory Committee.

    The working party have met for further consideration and the final policy document is attached.

    Recommending that the Committee approve the policy and forward it to Council for formal adoption.

  10. Top PROPOSED FIREWORKS BAN TAMAKI DRIVE

    At its meeting of 10 July 2006 the Arts, Culture and Recreation Committee resolved as follows:

    That it be recommended to the Planning and Regulatory Committee:

    1. That for reasons of public safety, the Arts Culture and Recreation Committee support a ban on the letting off of fireworks on Friday 3 November, Saturday 4 November and Sunday 5 November 2006, on the following areas of open space:

      Tamaki Drive from the intersection with Ngapipi Road to St Heliers, Watene Reserve, MJS Memorial, Orakei Domain, Selwyn Domain, Kohimarama Beach, Vellenoweth Green, St Helier's Bay Beach, Ladies Bay, Achilles Point

    2. That the ban be put in place under the provisions of Auckland City bylaw 20.3.1.
    3. That the Ngati Whatua o Orakei Reserves board be approached for its consent to extend the ban to the Whenua Rangatira and Okahu Bay.

    Recommending that this information be received.

  11. Top TEMPORARY LIQUOR BANS FOR THE 2006-07 YEAR

    Attaching a report requested by the Planning and Regulatory Committee at its December 2005 meeting regarding liquor ban requests for the 2006/2007 summer period.

    Recommending that the liquor bans be approved and that the Committee consider further liquor bans in parks following the completion of a report on liquor bans to the Committee's September 2006 meeting.

  12. Top TAMAKI DRIVE BUS LANE

    At its meeting on 12 July 2006 the Transport and Urban Linkages Committee resolved inter alia:

    1. That it be recommended to the Planning and Regulatory Committee and Council that new bus lanes be introduced on Tamaki Drive:
    1. That pursuant to Clause 25.5.7 of Part 25 - Traffic of the Auckland City Consolidated Bylaw 1998, Clause 25.5.5 is amended by the addition of new sub-clauses 25.5.5(zc) and (zd), which read:
    1. The traffic lane on the southern side of Tamaki Drive:
    1. The southern side of Tamaki Drive commencing at a point 160.0 metres east of the extended eastern kerb line of Kitemoana Street and extending west to a point 60.0 metres east of the extended eastern kerbline of Ngapipi Road.

    This restriction on the use of this traffic lane on the southern side of Tamaki Drive shall apply between the hours of 7.00 - 9.00am on weekdays except public holidays.

    1. The traffic lane on the northern side of Tamaki Drive:
    1. the northern side of Tamaki Drive commencing at a point 20.0 metres west of the extended western kerb line of Solent Street and extending east to the extended western kerbline of Solent Street.

    This restriction on the use of this traffic lane on the northern side of Tamaki Drive shall apply at all times.

    1. That the above resolution of Council regarding Tamaki Drive Bus Lane, be publicly notified.

    Recommending that the new bus lanes above be approved and forwarded to Council.
