    The minutes of the Planning and Regulatory Committee meeting held on Thursday, 14 December 2006, to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

  6. Top NEW SIGNS AND BILLBOARDS BY-LAWS EDUCATION AND ENFORCEMENT/BUDGET IMPACTS

    Advising that the new Signs and Billboards Bylaws will introduce substantial changes to rules for signs and billboards, resulting in a large amount of non-compliance and the need for additional staff resources and funding.

    Recommending that the budget impact of additional staff resources and legal requirements be reported to Combined Committees for consideration as part of the 2007/2008 annual plan and budget.

  7. Top LEGISLATION OF SIGNIFICANCE - SUBMISSION TO THE NEW ZEALAND FOOD SAFETY AUTHORITY ON THE PROPOSED IMPLEMENTATION OF THE DOMESTIC FOOD REVIEW

    Recommending that the Committee endorse Auckland City Council's submission to the New Zealand Food Standards Association on the "Domestic Food Review Transition Policy and Related Implementation Discussion Document".

  8. Top EXEMPTIONS TO PART 14 OF AUCKLAND CITY CONSOLIDATED BYLAW 1998 - LIQUOR CONTROL IN PUBLIC PLACES

    Recommending that the Mission Bay liquor ban be temporarily suspended during the 2007 Mission Bay Jazz and Blues Festival scheduled for Saturday, 17 February 2007. The event has traditionally involved members of the public taking small amounts of alcohol to the festival as part of a picnic.

    Also recommending that, in accordance with clause 14.1.3 of the Auckland City Consolidated Bylaw, the Council's resolution of 9 September 2004 adopting a liquor ban in Mission Bay for Thursday to Saturday nights from 10pm to 6am be amended during the 2007 Mission Bay Jazz and Blues Festival.

  9. Top APPOINTMENT OF PLANNING COMMISSIONERS - PLAN CHANGE 194

    Advising that proposed Plan Change 194 seeks to schedule nine buildings as category B heritage items within the Isthmus Plan. Sixteen primary submissions have been received, both in support and opposition to the plan change. A hearing of submissions is proposed to be held during April 2007.

    Recommending that the Committee appoint commissioners to the hearings panel.

  10. Top PLAN CHANGE 163 - RESIDENTIAL 1 AND 2 ZONES

    At the Council meeting held on 14 December 2006 it adopted the recommendations contained in the report of the Hearings Panel for Plan Change 163 - Residential 1 and 2 zones, which included the following recommendations from the Panel:

    That the Hearings Panel further recommends that the Council investigate the following administrative and district plan changes:

    • Fee reduction for work which contributes to the streetscape
    • A sliding scale for fees depending on the amount of work being done as opposed to a flat fee
    • Improvements to application assessment process - particularly in terms of time
    • Incentive for refurbishing buildings rather than building new
    • Fast tracking of applications for good practice
    • A heritage division for dedicated resourcing for heritage assessments
    • Practice notes / additional training for Council staff
    • Information for applicants so they know council advice is available
    • Development of a heritage division of the Urban Design Panel to provide heritage advice
    • Access to funding for undertaking restorative work, particularly in the Residential 1 zone.
    • Heritage policy changes.
    • Inclusion of rules providing for a sloping roof bonus
    • Review of the location and boundaries of the Residential 1 and 2 zones.

    Recommending that the Committee consider the recommendations from the Hearings Panel.

  11. Top URGENT DECISION - TEMPORARY LIQUOR BAN FOR THE AUCKLAND INTERNATIONAL CULTURAL FESTIVAL

    Attaching an urgent decision signed by the Deputy Mayor and the Committee chair on 2 February 2007 endorsing the extension of the temporary liquor ban in the Wesley War Memorial Park for the Auckland International Cultural Festival to cover the period from 6 am to 10 pm on Sunday, 25 February 2007.

  12. Top SIGNS AND BILLBOARDS BYLAWS

    At its meeting held on 31 January 2007, the Hobson Community Board resolved, inter alia, as follows:

    That the Board recommends to the Planning and Regulatory Committee's 15 February 2007 meeting that an independent commissioner with urban design skills be appointed to the hearings panel for the review of Auckland City's Signs and Billboards Bylaws.

    Recommending that the Committee consider the Hobson Community Board's resolution.
