    The minutes of the Planning and Regulatory Committee meeting held on Thursday, 12 July 2007 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

  10. Top REVIEW OF RESIDENTIAL 1 AND 2 ZONES RESOURCE CONSENT APPLICATIONS

    Presenting the conclusions of a review of application reporting and as-built results in the residential special character areas and responding to community and councillor concerns.

    Also advising that the review of 18 applications concludes that the great bulk of processed applications in the Residential 1 and 2 zones have been assessed with clarity and appropriate levels of professional judgement by Auckland City Environment's staff.

    Recommending that an enhanced programme of professional training and general district plan character area goal awareness be instituted by City Planning with Auckland City Environments, that a regular programme of proactive professional mentoring of grouped received applications be undertaken and a clear programme of qualitative monitoring of built outcomes in residential character zones be resourced and implemented as soon as possible.

  14. Top INTERIM ALCOHOL BANS

    Reporting on the completion of an initial evaluation of feedback and evidence provided by parks staff, police and four community boards [Maungakiekie, Eden/Albert, Tamaki and Mt Roskill]. The evaluation found that the interim ban areas were considered to be appropriate, and the bans were effective, providing the policy had a strong surveillance presence.

    Recommending that the committee approve extending the period the existing nine interim alcohol ban areas are in effect to 30 April 2008 and approve a temporary alcohol ban for all beaches, parks and reserves on Waiheke Island from 10 pm to 6 am from labour Weekend 2007 until 30 April 8008.

    Also recommending that officers report to the December committee meeting on the nine interim alcohol ban areas, particularly in relation to issues of displacement and possible threshold criteria for future alcohol ban areas and that the committee endorse the use of the special consultative procedure to gauge community views on making the nine interim alcohol ban areas, and the Waiheke temporary alcohol ban areas, permanent.

  15. Top LIQUOR LICENSING ADMINISTRATION AND HEARINGS PROCESS

    Recommending that the committee approve the granting of landowner consent for the issue of an airspace licence over a strip of legal road approx. 600mm wide adjoining Lot 1 DP 196190 on Harold Street, Enfield Street and Edwin Street for overhanging louvres, balconies and cladding.

  18. Top LANDOWNER'S CONSENT TO BUILDING PROJECTION OVER ROAD - 509 NEW NORTH ROAD, KINGSLAND

    Advising that the owner of the property at 509 New North Road proposes to extend the building to the same line as the adjacent retail shops and to construct a verandah over the footpath. The building is set back approximately 3 metres from the otherwise continuous buildings in Kingsland and the owner wishes to improve the appearance of the front of the building to make it more attractive and more compatible with the historic feeling of Kingsland.

    Recommending that the committee approve the proposed verandah over the affected area of legal road at 509 New North Road and to the issue of an airspace licence.

    Recommending that the panel for Auckland City Council comprise one independent commissioner with representation in the legal or planning professions, with some experience related to public utilities.

  21. Top GOOD NEIGHBOUR INITIATIVE

    Reporting on the Good Neighbour initiative which has resulted in a 10% drop in the number of requests for service by neighbours claiming that illegal building activity was taking place next door. The project provides advice to neighbours of properties that are undertaking building work in excess of $200,000.

    Recommending that the threshold for consented building works be lowered to $100,000 and that additional resources be approved.
