    That this item be deleted.

    That the reports requested/pending for the month of April 2005 from the Hearings Services Manager be received.

  6. Top UPDATE ON THE HORTICULTURAL SOILS ISSUE

    That the committee is updated on the progress of the sampling trial as information comes to hand.

  7. Top CENTRAL AREA WEST BUS PRIORITY – BYLAW ALTERATION

    That the committee recommends to Council

    1. That subject to section 25.5.7 of the Consolidated Bylaw, section 25.5.5 of the Consolidated Bylaw be altered by resolution to include the following clauses:

      Sturdee Street

      1. The traffic lane on the northern side of Sturdee Street:

        Commencing at a point 15 metres east of the eastern kerb alignment of Market Place and terminating at a point 175 metres east of the eastern kerb alignment of Market Place.

        This restriction on the use of this traffic lane on the northern side of Sturdee Street shall only apply between 6.00am and 10.00am and between 3.00PM and 7.00PM on weekdays other than public holidays.

        Albert Street

      2. The traffic lane on the eastern side of Albert Street:
        1. Commencing at a point 20 metres south of the southern kerb alignment of Customs Street West and terminating at a point 48 metres north of the northern kerb alignment of Swanson Street.
        2. Commencing at a point 15 metres south of the southern kerb alignment of Swanson Street and terminating at a point 27 metres north of the northern kerb alignment of Wyndham Street.
        3. Commencing at a point 5 metres south of the southern kerb alignment of Wyndham Street and terminating at a point 59 metres south of the southern kerb alignment of Wyndham Street.
        4. Commencing at a point 40 metres south of the southern kerb alignment of Victoria Street and terminating at a point 53 metres north of the northern kerb alignment of Wellesley Street.
      3. The traffic lane on the western side of Albert Street:
        1. Commencing at a point 39 metres north of the northern kerb alignment of Swanson Street and terminating at a point 17 metres south of the southern kerb alignment of Wolfe Street.
        2. Commencing at a point 38 metres north of the northern kerb alignment of Customs Street West and terminating at a point 45 metres south of the northern kerb alignment of Quay Street.

        These restrictions on the use of these sections of traffic lane on Albert Street shall only apply between 6.00am and 10.00am and between 3.00PM and 7.00PM on weekdays other than public holidays.

        Mayoral Drive

      4. The traffic lane on the eastern side of Mayoral Drive:

        Commencing at a point 15 metres south of the southern kerb alignment of Wellesley Street and terminating at a point 91 metres south of the southern kerb alignment of Wellesley Street.

        This restriction on the use of this traffic lane on the eastern side of Mayoral Drive shall only apply between 6.00am and 10.00am and between 3.00PM and 7.00PM on weekdays other than public holidays.

        Vincent Street

      5. The traffic lane on the eastern side of Vincent Street:

        Commencing at a point 55 metres south of the northern kerb alignment of the traffic island on the southern side of Mayoral Drive and terminating at a point 38 metres east of the eastern kerb alignment of Pitt Street.

        This restriction on the use of this traffic lane on the eastern side of Vincent Street shall only apply between 6.00am and 10.00am and between 3.00PM and 7.00PM on weekdays other than public holidays.

    2. That subject to section 25.5.9 of the Consolidated Bylaw, section 25.5.8 of the Consolidated Bylaw be altered by resolution to include the following clauses:
      1. Proceed straight ahead across Wellesley Street from the southbound left turn only lane of Albert Street at all times.
      2. Proceed straight ahead across Wyndham Street from the southbound left turn only lane of Albert Street at all times.
      3. Proceed straight ahead across Swanson Street from the southbound left turn only lane of Albert Street at all times.
      4. Proceed straight ahead across Swanson Street from the northbound left turn only lane of Albert Street at all times.
      5. Proceed straight ahead across Customs Street West from the southbound left turn only lane of Albert Street at all times.

  8. Top SETTING DOG REGISTRATION AND ANIMAL CONTROL FEES

    That the dog registration fees and animal control fees remain at their current levels for the 2005-2006 financial year.

  9. Top EXTENDING COUNCIL'S BOUNDARY DOWN TO MEAN LOW WATER

    The Chair moved:

    That the gazette notice of 24 March 2005 containing the Auckland City Boundary Alteration Notice be widely distributed to groups in the Council and the new boundaries be advertised for public information in the City Scene and be forwarded to all Community Boards for their agenda.

    Councillor Millar moved by way of addition:

    That in advertising/notifying the new boundaries, the Auckland City Boundary Alteration Notice be extended to dog owners.

    The Chair put the substantive motion:

    1. That the gazette notice of 24 March 2005 containing the Auckland City Boundary Alteration Notice be widely distributed to groups in the Council and the new boundaries be advertised for public information in the City Scene and be forwarded to all Community Boards for their agenda.

      1. RailVolution, Salt Lake City, Utah, USA, September 8-11, 2005.
      2. Sustainable Planning 2005, Bologna, Italy, September 12-14, 2005.
    2. B. That the attendance by Councillor Faye Storer, Chair Planning and Fixtures Committee to the following conference, including any meetings related to this conference, be approved:

    That the Council resolution 15 A of its meeting held on 31 March 2005 be noted.

  12. Top RESOURCE CONSENT NOTIFICATION

    That officers investigate the issues raised by Board Member Christopher Dempsey in his report dated 12 March 2005 addressed to the Eden/Albert Community Board and report to the Planning Fixtures Committee.

  13. Top TEMPORARY ADVERTISING BANNERS ON BUILDING SITES

    That this item be considered in conjunction with Item 15.

  14. Top ENFORCEMENT OF ILLEGAL SIGNS – PONSONBY ROAD, JERVOIS ROAD, DOMINION ROAD

    1. That requests by committees, community boards, or members of the public for enforcement across whole topics or areas be referred as submissions for compliance projects.
    2. That the Project Manager (Compliance), Incident Management team meets with the Planning and Fixtures Committee and members of the Planning and Regulatory Committee in a workshop in April/May to gather submissions for compliance projects.
    3. That Auckland City Environments scopes and prioritises submissions for compliance projects, including options for project delivery, and reports to the Planning and Regulatory Committee in June 2005.
    4. That the removal of sandwich boards in Ponsonby and Jervois Roads occurs as a test project in May/June.

  15. Top BANNER ADVERTISING – CONSTRUCTION SITES

    The Chair moved:

    1. That item 13 be taken with item 15.
    2. That Amity Media be advised that banners erected over structures during the course of construction be required to comply with billboard regulations under part 27B of the signs bylaw.

    Cr Armstrong moved by way of amendment:

    1. That banners erected over structures during the course of construction be required to comply with billboard regulations under part 27B of the signs bylaw, with the exception of a 2-year trial of advertising signs on building sites by Amity Media, commencing 1 May 2005, subject to conditions.

    The amendment was LOST on a show of hands by 5 votes to 3.

    The Chair put the substantive motion

    1. That item 13 be taken with item 15.

  16. Top COMPLIANCE MONITORING AND ENFORCEMENT OF RESOURCE CONSENTS – OPERATIONS POLICY WITH SPECIFIC REFERENCE TO THE MATTERS ARISING IN RELATION TO THE DEVELOPMENT OF 17 KELLY STREET, MT EDEN

    That the report of the Principal Planner dated 5 April 2005 on Compliance Monitoring and Enforcement of Resource Consents – Operational Policy with specific reference to the matters arising in relation to the development of 17 Kelly Street, Mt Eden be received and the committee notes the outstanding matters to be addressed by council.
