CONFIRMATION OF MINUTES
That the minutes of the Planning and Regulatory Committee
meeting held on Thursday 11 August 2005 be confirmed as a true and correct
record.

EXTRAORDINARY BUSINESS
There was no extraordinary business.
PUBLIC FORUM
There were no requests to speak in public forum.
PLAN CHANGE 161 RESIDENTIAL 5 ZONING AT BEACHCROFT AVENUE,
ONEHUNGA
- That the Committee recommends to
Council that plan change 161 be approved and incorporated into the Auckland City
District Plan: Isthmus section 1999.
- That the Committee recommends to Council that the
manager: Isthmus and Islands resource management be authorised to publicly
notify the date of which plan change 161 will be operative.
CARRIED
PLAN CHANGE 158 "MARINO GARDENS" 145 MT. EDEN ROAD.
- That the committee recommends to
council that plan change 158, be incorporated into the Auckland City District
Plan: Isthmus Section 1999.
That the committee recommends to council that the
Manager: Isthmus and Islands Resource Management be authorised to publicly
notify the date on which the plan change will become operative.
CARRIED
RESOURCE MANAGEMENT AMENDMENT ACT 2005
- That the Group Managers City Planning,
ACE and Democracy Services be authorized to take the necessary steps to ensure
compliance with the amendments contained in the Resource Management Amendment
Act 2005.
- That a training session for Planning Commissioners be
set up with regard to the Resource Management Amendment Act 2005.
Councillor Abel moved by way of addition:
- That Auckland city investigate the liability and
insurance implications and mitigation of the adverse effects of the development,
subdivision, or use of contaminated land in section 31(1)(b)(iia) of the
Resource Management Amendment Act 2005.
The motion was declared LOST on a show of hands.
Councillor Armstrong moved the following amendment by way of
addition:
- That officers be requested to advise the committee
if they consider there is increased risk or liability from the amendment and if
so what steps Council should take to mitigate these.
The amendment was declared CARRIED on a show of hands
The Chairman put the substantive motion:
- That the Group Managers City Planning, ACE and
Democracy Services be authorized to take the necessary steps to ensure
compliance with the amendments contained in the Resource Management Amendment
Act 2005.
- That a training session for Planning Commissioners
be set up with regard to the Resource Management Amendment Act 2005.
- That officers be requested to advise the committee
if they consider there is increased risk or liability from section 31(1)(b)(iia)
of the Resource Management Amendment Act 2005 and if so what steps Council
should take to mitigate these.
- That the report of the Acting Group Manager City
Planning regarding Resource Management Amendment Act 2005 and these resolutions
be forwarded to the Planning Fixtures Committee and the Environmental, Heritage
and Urban Form Committee for their information.

APPOINTMENT OF COMMISSIONERS
8.1. PLAN CHANGE 163 AMENDMENTS TO THE PROVISIONS OF THE RESIDENTIAL
1 AND 2 ZONES IN AUCKLAND CITY.
That Cr Caughey be given the delegated
authority to appoint hearing commissioners for Plan change 163.
CARRIED
