    That the minutes of the Planning and Regulatory Committee meeting held on Thursday, 15 March 2007, be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    That an extraordinary item regarding landowner consent for an airspace licence over road at  21 Viaduct Harbour Avenue be considered at agenda item 11 for the reason that the building which is being constructed on this site is nearly complete and has a veranda infringement.

  6. Top EROTICA PARADE

    The Chairman moved:

    1. That consideration of any changes to the Public Places Bylaw regarding the Erotica Parade be undertaken during the bylaw review and workshop process.
      Councillor Raffills moved the following amendment as an addition:
    2. That the Committee notes the input from the public on the Erotica Parade issue.

    The Chairman put the substantive motion:

  7. Top GARAGE CONVERSIONS TO PROVIDE SLEEP OUT ACCOMMODATION

    That Auckland City Environments continues to investigate and resolve potential illegal garage conversions that come to its attention.

  8. Top MT WELLINGTON QUARRY - STONEFIELDS

    That the Eastern Bays Community Board's resolution from its 21 March 2007 meeting be received.

    CARRIED

  9. Top URBAN DESIGN PANEL TRIGGER REVIEW

    1. That the Committee endorses the following reviewed triggers for referral to the Urban Design Panel:

    Mandatory UDP review:

    • developments of 20 or more residential units in any zone
    • any development adjacent to or within the surrounds of a scheduled building
    • integrated housing developments or planned unit developments of 10 or more units
    • any significant new building or alteration in the Business 3 zone
    • medium or major scale Council projects, including streetscape upgrades and community facilities
    • any significant new building or alteration in the Residential 1, 2 and 3 zones
    • all new buildings and significant alterations within the CBD
    • that an architect experienced in heritage be included on the panel for any residential 1, 2 and 3, heritage overlays, centre plans or scheduled buildings
    1. That if the Urban Design Panel believes that it needs particular expertise on a specific proposal, it has the ability to second a specialist onto the panel.

  10. Top EXCLUSION OF THE PUBLIC : LOCAL GOVERNMENT OFFICIAL INFORMATION AND MEETINGS ACT 1987

    1. That the public be excluded from the following part(s) of the proceedings of this meeting.

    The general subject of each matter to be considered while the public is excluded, the reason for passing this resolution in relation to each matter, and the specific grounds under Section 48(1) of the Local Government Official Information and Meetings Act 1987 for the passing of this resolution are as follows:

    Good Reason to withhold exists under section 7 because of the discussion of individuals who are nominated to join the panel

    This resolution is made in reliance on Section 48(1)(a) of the Local Government Official Information and Meetings Act 1987 and the particular interest or interests protected by section 6 or section 7 of that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public are as follows:

    1. That the Committee endorses the membership of Professor Jennifer Dixon to the Urban Design Panel.

  11. Top LANDOWNER CONSENT FOR AIRSPACE LICENCE OVER ROAD AT 21 VIADUCT HARBOUR AVENUE, AUCKLAND CENTRAL

    1. That landowner consent be approved for the entrance canopy and roof structures that overhang the boundary into the legal road reserve at 21 Viaduct Harbour Avenue, and the issue of an airspace licence on terms and conditions to be approved under the appropriate financial delegation.
    2. That the airspace licence at 21 Viaduct Harbour Avenue will lapse when or if the existing building is removed, demolished or the roof overhang/veranda is removed.
