  4. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

  7. Top AUCKLAND DOMAIN - RAF BOMER COMMAND MEMORIAL

    Updating the Subcommittee on the progress of work done with representatives from the RAF Bomber Command Association in exploring options in the Auckland Domain to commemorate Royal Air Force (RAF) Bomber Command personnel lost in World War II. Since the 23 May 2007 meeting of this Subcommittee, officers have met on two occasions with Bomber Command representatives to discuss the proposed integrated memorial. Officers also organised a wider discussion with the RAF Bomber Command Association, Auckland War Memorial Museum staff, the Returned Services Association and other armed services representatives on 30 May 2007.

    Recommending that the memorandum of the Senior Landscape Architect, dated 6 August 2007, be received.

  8. Top CITYWIDE ARTWORKS FUND 2007/2008

    Reporting on the CAPEX budget for public artworks, which has been included in the Annual Plan each year since 1998/1999. Since 2004/2005 this budget, now the Citywide Artworks Fund, has been included in the Open Space Asset Management Plan (AMP). $300,000 has bee allocated in the 2007/2008 financial year for capital works, consultation, consent processes and project management. Criteria have been developed to determine the allocation of funding from the Citywide Artworks Fund, and are weighted to favour projects that are significantly place, project, people or special feature related.

    Recommending that the Subcommittee endorse the proposed CAPEX Citywide Artworks Fund budget for 2007/2008.

  9. Top DAVID LANGE MEMORIAL ARTWORK

    Updating the Subcommittee on the progress of the proposed major artwork memorial to the late Prime Minister David Lange. In September 2006, the Arts, Culture and Recreation Committee endorsed the proposal to locate a major memorial artwork for David Lange on the Mason Avenue Entrance on the Otahuhu Recreation Precinct. The David Lange Memorial Trust have engaged an artist, Virginia King, and would like to install the memorial by August 2008. The artwork concept, which is still under development, incorporates landscaping around the artwork which will form a section of the precinct's entranceway.

    Officers have recently met with the David Lange Memorial
    Trust's project manager. It is proposed that from November 2007 the David Lange memorial artist and the Otahuhu Recreation Precinct lead landscape designer will lead the process to integrate the landscape designs of the artwork and the recreation precinct.

    Recommending that the Subcommittee endorse the proposal to fund $80,000 landscaping costs of the David Lange Memorial artwork over two years from the Citywide Artworks Fund, and that officers continue working with the David Lange Memorial Trust project manager and the artist to integrate the David Lange Memorial artwork into stage two of the Otahuhu Recreation Precinct development project.

  10. Top REQUEST FOR REMOVAL AND STORAGE OF PUBLIC ARTWORKS, AUCKLAND ART GALLERY

    Reporting on the proposed redevelopment of the Auckland Art Gallery, which requires the removal and re-siting of three public artworks. The resource consent for the proposed redevelopment of the Auckland Art Gallery, currently under appeal, has been upheld by the Environment Court in its Interim Decision (31 August 2007) pending a design alteration to one part of the proposed roof. Construction, currently scheduled from December 2007 to September 2010, necessitates the removal and storage of the artworks. The artworks affected are Opened Stone by Hiroaki Ueda, Sappho by Aleko Kyriakos, and Double L Excentric Gyratory by George Rickey. It is considered that the three public artworks meet conditions II and III of the criteria of initiating a re-siting or removal review process.

    Recommending that Double L Excentric Gyratory by George Rickey be removed, stored and re-sited near its current location as part of the redevelopment of the Auckland Art Gallery, and that Opened Stone by Hiroaki Ueda and Sappho by Aleko Kyriakos be removed and stored pending the Auckland Art Gallery construction works commencing in December 2007.

  11. Top ISSUE OF COPYRIGHT FOR PUBLIC ARTWORKS

    Providing a response to a resolution passed by this Subcommittee at its meeting on 25 July 2007, which reads inter alia:

    1. "That officers report back to the Arts, Culture and Recreation Committee on issues around the recent court decision and the implications for artists, trusts and public institutions in relation to commercial use of images, case law in Australia, and the merits of supporting an appeal or seeking legislative change."

    A process is currently being undertaken to respond, which involves officers seeking legal advice from the council legal team on the issues and implications on what council can do to respond to any potential issues in regards to the legal decision, further research on what is occurring internationally (in particular Australia) in relation to the commercial use of images of public art, and consultation with key relevant agencies, such as Artist Alliance, Creative New Zealand and the Ministry of Culture Heritage.

    Recommending that the memorandum of the Arts Planner, dated 12 September 2007, be received, noting that a full report on the findings of this investigation will be presented to the relevant committee of council in early 2008.
