    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    1. The local authority by resolution so decides; and

    2. The presiding member explains at the meeting at a time when it is open to the public,-

      1. The reason why the item is not on the agenda; and

      2. The reason why the discussion of the item cannot be delayed until a subsequent meeting."

  6. Top EASTERN TRANSPORT CORRIDOR/EASTERN TRANSIT INITIATIVE UPDATE REPORT

    Presenting an update on the status of the Memo of Understanding, the involvement of ARTA (Auckland Regional Transport Authority), the Allens Road route, the concerns of property owners in the Tamaki area and the need for the consideration of the impact on potentially complementary projects.

    Recommending:

    1. That the Transport and Urban Linkages Committee:
      1. endorse the revised project scope as a basis for the Council's involvement in the project
      2. authorise His Worship the Mayor and the Chief Executive Officer to sign the Memorandum of Understanding on behalf of the Council.
    2. That the Manager Transport Planning report back on the Allens Road project following Transit New Zealand's presentation to the June meeting of the project Political Steering Group.
    3. That the Transport and Urban Linkages Committee Chairman write to the Auckland Regional Transport Authority (ARTA) Board Chairman, strongly encouraging ARTA to take a full role in the future planning and development of the project.
    4. That the Transport and Urban Linkages Committee recommends to the Eastern Transport Corridor Project Group that a reference group be established comprising key stakeholders that may be impacted upon by the project.
    5. That the Manager Transport Planning report back on potential projects that may be complementary or influenced by the Eastern Transport Corridor project.

  7. Top UNIVERSITIES TRAVEL PLAN

    Recommending that the Transport and Urban Linkages Committee:

    1. Endorse the Council's involvement in the joint project team involved in the development of the universities travel plan for the Central Business District (CBD) campuses.
    2. Endorse the Council becoming a signatory to the memorandum of understanding.

  8. Top TRANSIT NZ STATE HIGHWAY (SH) 1 HARBOUR BRIDGE TO CITY (HBTC)

    Advising that, in March 2005, Transit New Zealand advised the Council that in relation to the Harbour Bridge to City (HBTC) their current preferred option is the northbound tunnel, and that they propose to review and further assess the previous HBTC studies to identify a preferred option to progress to the next stages of planning which could be different to the northbound tunnel option.

    That the Transport and Urban Linkages Committee:

    1. Reaffirm its commitment to working with Transit NZ to expedite completion of the SH1 Harbour Bridge to City project, a component of the Central Motorway Improvements.
    2. Reaffirm the councils position to Transit NZ that the option of widening the current viaduct is unacceptable.
    3. That Transit NZ be informed that the Council expects the improvements to be designed to mitigate the impact of the corridor through Victoria Park by trenching and tunnelling.
    4. That Transit NZ investigate the implementation of northbound and southbound bus priority measures through the St Mary's Bay corridor to accommodate and link into the proposed Northern busways.
    5. That Transit NZ be informed that Victoria Park is an irreplaceable and valued community asset and the useable area of park should not be further compromised.
    6. The project be expedited to realise the full benefits of the other component projects of the Central Motorway Improvements that are either completed or due for completion by the end of 2006.
    7. That Transit NZ be requested to respond to the committee on the effect of the ramp metering project on the HBTC project and CMJ Stage 2.
    8. Support the use of regional funding to fund the Harbour Bridge to City project, with the understanding that the region will continue to advocate that these projects are funded from national funds wherever possible.
    9. The project be co-ordinated with the Auckland City's CBD into the future project work particularly the development of the Victoria Quarter plan including the proposed plan change and the redevelopment of Wynard Wharf..

  9. Top TRANSIT NZ STATE HIGHWAY (SH) 1, ELLERSLIE PANMURE HIGHWAY NORTHBOUND ON-RAMP PROPOSED IMPROVEMENTS

    Advising that Transit New Zealand is currently investigating possible improvements to State Highway 1 motorway from the northbound on-ramp of the Ellerslie Panmure Highway interchange to the Main Highway underpass. Two options are being considered, the first is to lengthen the existing northbound on-ramp, the second is to construct an auxiliary lane. The second option provides the greater traffic benefits, but changes to the motorway network may affect the Ellerslie railway station and in turn delay the programmed upgrade of the stations facilities.

    Recommending that:

    1. Transit NZ be informed that the Transport and Urban Linkages Committee and the Maungakiekie Community Board's preferred option for the upgrade of the Ellerslie northbound on-ramp is Option 2, the construction of an auxiliary lane.
    2. Transit NZ be requested to respond to the Transport and Urban Linkages Committee and the Maungakiekie Community Board on the effect of their ramp metering project on the proposed improvements at the Ellerslie northbound on-ramp.

  11. Top CONSULTATION ON PROPOSED BUS PRIORITY MEASURES AT NEW NORTH ROAD, BOND STREET AND SANDRINGHAM ROAD INTERSECTION

    2. That the Eden/Albert Community Board be informed of the outcome of the public consultation process.
    3. That the bus priority measures for the New North Road/Bond Street intersection be approved for implementation.
    4. That a report be presented to the next meeting of the Council to seek approval by resolution of the following alteration of the Auckland City Consolidated bylaw 1999, to add a new subclause (ii) in clause 25.5.5 (w):

      The traffic lane on the southern side of New North Road:

      1. commencing at a point 35 metres east of the eastern kerb alignment of Bond Street and terminating at a point 6 metres east of the eastern kerb alignment of Bond Street. The restriction on the use of this traffic lane shall apply at all times.

  13. Top CENTRAL AREA WEST BUS PRIORITY SCHEME OVERVIEW

    Updating the Transport and Urban Linkages Committee on the focus of the Central Area West Bus Priority Scheme Overview project which is to make bus travel quicker and more reliable through the Central Area for North Shore and western routes bus passengers, that its implementation will be in July 2005. The report also requests that green pavement surface be laid at inception to aid with traffic management and that bus lane colouring be consistent with regional standards.

    Recommending that:

    1. The Transport and Urban Linkages Committee notes the progress made on the Central Area West bus priority project.
    2. That the section of southbound bus lane south of Wyndham Street have green pavement surface laid at inception to aid with traffic management.
    3. That bus lane colouring consistent with the regional standards adopted by the Council be considered as part of the review following several months of bus lane operation.

  14. Top VICTORIA STREET WEST BUS PRIORITY

    Updating the Transport and Urban Linkages Committee on the results of the consultation on the Victoria Street West Bus priority measures, and seeking approval to amend the bylaw to implement a westbound bus advance lane at the intersection of Victoria Street West/Wellesley Street West and Halsey Street and a bus pocket west of this intersection.

    Recommending that:

    1. The proposed Victoria Street West bus advance lane at the intersection of Victoria Street West, Wellesley Street West And Halsey Street and a bus pocket west of this intersection on Victoria Street West proceed to installation.
    2. The Transport and Urban Linkages Committee recommends that the Council pass the following resolution to introduce a new bus lane on Victoria Street West:

      That pursuant to Clause 25.5.7 of Part 25 – Traffic of the Auckland city Consolidated Bylaw 1998, Clause 25.5.5 by amended by the addition of a new sub-clause 25.5.5 (za), which reads:

      1. The traffic lane on the southern side of Victoria Street West:
        1. Commencing at the point 25 metres east of the easternmost kerb alignment of Wellesley Street West and terminating at a point 35 metres west of the easternmost kerb alignment of Wellesley Street West. This restriction on the sue of this traffic lane on the southern side of Victoria Street West shall apply at all time.
    3. That the above resolution be publicly notified.

  16. Top AMENDMENTS TO CLAUSES 1.1.1 AND 25.12-25.17 OF BYLAW: SPEED LIMITS

    Advising that under the Land Transport Rule: Setting of Speed Limits 2003 the Auckland City Council is now empowered to set speed limits on roads within its jurisdiction. As a transitional step, the Council is required to make a bylaw designating an area as an urban traffic area. This procedure has been carried out under the special consultative procedure where only three submission were received, all in favour of the proposed course of action. The proposed amendments to the Speed Bylaw will confirm the existing speed.

    It is recommended that:

    1. This report (including the attached Appendix 1) be received;
    2. It be a recommendation to the Council that:
      1. the Council notes that its decisions are made in accordance with the applicable provisions of section 77-82 of the Local Government Act 2002 ("LGA 2002"), and the Council has under section 79 in its discretion made judgments determining that the procedures adopted are appropriate to achieve compliance;
      2. the council records that the special speed limits (other than 50km/h in urban areas and 100km/h in rural areas) currently in force in the Council's territory and which would be validated if the proposed bylaw amendments are adopted, are set out in the schedules entitled "Special Saved Speed Limits".
      3. The Council, endorse the schedules entitled "Special Saved Speed Limits" and plans entitled "Auckland City Speed Limits Plan No.AKS0001/1 and Auckland City Speed Limits Plan No. AKS0002/1 Waiheke Island".
      4. The Council amend clauses 1.1.1 and 25.12 - 25.17 of the bylaw as detailed in Appendix 1.

  17. Top PARNELL PAY AND DISPLAY PARKING TRIAL

    Advising that, as street parking in Parnell is heavily used by visitors who have a variety of parking needs, it is proposed to undertake a three month trial using the current pay and display regime (with the appropriate tariffs) to allow visitors to determine the length of stay they require.

    Recommending:

    1. That the Parnell pay and display trial be undertaken for three months with the tariff set at $2 for the first hour, $3 for the second hour, $4 for the third hour and $5 for each additional hour.
    2. That the Manager, Traffic and Roading Services report back to the Transport and Urban Linkages Committee on the result of the trial.

  19. Top DECLARATION OF LAND TO BE ROAD AND OTHER LAND TO SURPLUS AND SOLD – 198 GREENLANE WEST, GREENLANE.

    Advising the Transport and Urban Linkages Committee that the major roading improvements along Greenlane West between Great South Road and Manukau Road have been completed and that, with the completion of the project, the Committee's approval is now required to declare the frontage strip from the property at 198 Greenlane West legal road and the remaining leasehold interest in the property surplus to roading requirements.

    In order to declare land road and dispose of surplus land the Transport and Urban Linkages Committee recommends:

    1. That the three-metre wide strip along the Greenlane West frontage of the property at 198 Greenlane West, Greenlane comprising 122m2 and being part of Lot 176 DP 18124 Certificate of Title 9B/370 be vested as legal road.
    2. That it be a recommendation to the Finance and Corporate Business Committee:
      1. That approval be given to declare the balance interest in the land at 198 Greenlane West, comprising 1182m2 and being the leasehold estate created by lease B930177 in Lot 176 DP 18124 Certificate of Title 9B/370, surplus to council's public work requirements.
      2. It is noted that Council has complied with its obligations under section 40 of the Public Works Act 1981 and therefore approval is given to dispose of the balance interest in the land in accordance with the requirements of section 42 of the Public Works Act 1981, on terms and conditions to be approved under delegation.

  20. Top DECLARATION OF COUNCIL LAND AS ROAD – 93-99 ROSEBANK ROAD, AVONDALE

    Advising the Transport and Urban Linkages Committee that, during the laying of new underground cables along Rosebank Road, it was discovered that the footpath adjacent to the Avondale Community Centre was within the property boundary of the Centre rather than part of the legal road. After investigation of the options it was decided that the Centre's land be surveyed off and the area declared road.

    Recommending that the Transport and Urban Linkages Committee, in order to regularise the boundary between the Avondale Community Centre and the legal road, recommends to Council the declaration that, pursuant to Section 114 of the Public Works Act 1981, Sections 1, 2 and 3 SO 350262 totalling 84m2, being part of 93-99 Rosebank Road, Avondale, be road.

  21. Top RENAMING OF PARTS OF GRAFTON GULLY

    Advising that the Hearings Panel decision on renaming of three parts of roads at Grafton Gulley means that two of the three names (Grafton Road and Stanley Street) can be recommended to the Transport and Urban Linkages Committee but, as the third (Henry Nicol Place) was not part of the consultative procedure, the Council will need to undertake further consultation on that name.

    Recommending:

    1. That the recommendations of the hearing panel be received.
    2. That it be recommended to Council that the names for two parts of roads in the Grafton gully area (Grafton Road and Stanley Street) be adopted, and that consultation with affected parties takes place on renaming the third part of road, 'Henry Nicol Place'.
