    The minutes of the Works and Services Committee meeting held on Thursday, 3 February 2005 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    “An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting.”

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    “Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion.”

  6. Top CONSULTATION STRATEGY FOR 2001 DRAINAGE NETWORK CONSENTS

    Updating the Works and Services Committee on the resource consent applications for the continued operation of Auckland City's drainage network; and the planned public consultation regarding the development of a “best practical option” for operation of the network.

    Recommending that public consultation in respect of strategic outcomes for the drainage network consents be undertaken as part of the Council's 2006/2007 Long Term Council Community Plan to establish the context for environmental outcomes sought through the 2001 network consents.

  8. Top 98 GRAMPIAN ROAD: HEARING OF OBJECTION TO NOTICE TO INSTALL STORMWATER AND WASTEWATER DRAINS

    Proposing that the Works and Services Committee defer the continuation of the 98 Grampian Road Hearing to its April 2005 meeting as the outcome of the requested confidential report titled 'Construction of Works on Private Land' which has been tabled at today's meeting, has implications to all further hearings. Delaying the hearing for 98 Grampian Road allows the objectors the opportunity to incorporate any outcomes of this report to their processes.

    Recommending that:

    1. That the Committee resolutions on the policies associated with accessing private land for drainage works be forwarded to Mr & Mrs Parkinson of 98 Grampian Road.
    2. That Mr & Mrs Parkinson be invited to add to their earlier objection submission aspects they consider relevant given the new Committee resolutions referred to in A above.
    3. That if Mr & Mrs Parkinson wish to have their additional submissions heard then the hearing be conducted as part of the Works and Services Committee meeting on 7 April 2005.
    4. That final deliberations on the Parkinson's objection be postponed until after presentation of any additional submissions.
