    The minutes of the Works and Services Committee meeting held on Monday, 2 April 2007 to be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "An item that is not on the agenda for a meeting may be dealt with at that meeting if-

    (a)

    The local authority by resolution so decides; and

    (b)

    The presiding member explains at the meeting at a time when it is open to the public,-

     

    (i)

    The reason why the item is not on the agenda; and

     

    (ii)

    The reason why the discussion of the item cannot be delayed until a subsequent meeting."

    Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

    "Where an item is not on the agenda for a meeting,-

    (a)

    That item may be discussed at that meeting if-

     

    (i)

    That item is a minor matter relating to the general business of the local authority; and

     

    (ii)

    The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

    (b)

    no resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion."

    A period of time (approximately 20 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 5 minutes per item is allowed, following which there may be questions from members.

  6. Top PRIORITY FOR DRAINAGE ENVIRONMENTAL IMPROVEMENT WORKS

    Reporting on drainage environmental improvement works with specific comment on completing works in the Orakei Basin. The report also discusses priorities for stormwater quality improvements and also considers the new paradigm that has been developed for the management of urban stormwater quality in Auckland city. The proposed dredging of the Orakei Creek is considered in the context of this new approach and wider priorities.

    Recommending that the high priority for dredge and replace works in the Orakei Creek arms be re-evaluated on a city-wide basis and funds released in forthcoming years be directed to higher priority stormwater improvements works in the city.

    Also recommending that council officers investigate the opportunity to have the $2.4m Infrastructure Auckland funding allocated for Orakei Creek transferred to a similar stormwater quality enhancement project elsewhere.

  7. Top DRAFT WASTE MANAGEMENT PLAN - CENTRAL AREA

    Attaching a draft Waste Management Plan - Central Area Section which reviews current achievements and services, and proposes a series of actions to be undertaken to further reduce waste being disposed of to landfill.

    Recommending that the Committee appoint commissioners to hear the submissions on the special consultative procedure and give those commissioners delegation to make a recommendation to the Council. Also recommending that council adopts the statement of proposal included in the agenda report for the purposes of the special consultative procedure for the Waste Management Plan - Central Area and approves the recommended hearings panel.

    The public conduct of the part of the meeting would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2)(b)(ii)  The withholding of the information is necessary to protect information where the making available of the information would be likely unreasonably to prejudice the commercial position of the person who supplied or who is the subject of the information.

    Section 7(2)(h)  The withholding of the information is necessary to enable the local authority to carry out, without prejudice or disadvantage, commercial activities.

    In particular, the report contains information which is commercially sensitive and would be likely unreasonably to prejudice the commercial position of the organisation which supplied the information. It also allows Council to carry out, without prejudice or disadvantage, commercial activities.

    S48(1)(a) The exclusion of the public from the part of the meeting is necessary to enable the local authority to deliberate in private on its decision or recommendation.
