  2. Top HEARING OF OBJECTION : 68 HUIA ROAD, PT CHEVALIER

    1. That the Committee recommence hearing the objection of Mr and Mrs Barker to install a public drain through 68 Huia Road, Point Chevalier.

    CARRIED

    Mr and Mrs Barker tabled and spoke to the attached submission on the updated peer review report.

    The meeting adjourned at 2:10pm and reconvened at 2:23pm.

    The Chairman moved:

    1. That the public be excluded from the following part(s) of the proceedings of this meeting.

    The general subject of each matter to be considered while the public is excluded, the reason for passing this resolution in relation to each matter, and the specific grounds under Section 48(1) and Section 48(2) of the Local Government Official Information and Meetings Act 1987 for the passing of this resolution are as follows:

    Sections 48(1)(d) and 48(2)(a)(i)

    This resolution is made in reliance on Section 48(1) of the Local Government Official Information and Meetings Act 1987 and the particular interest or interests protected by that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public are as follows:

    That the exclusion of the public from the whole or the relevant part of the proceedings of the meeting is necessary to enable the local authority to deliberate in private on its decision or recommendation in any proceedings to which this paragraph applies

    Section 48 (1) (d)

     

    Paragraph (d) of subsection (1) of this section applies to –

    (a) any proceedings before a local authority where –

    (i) The local authority is required, by any enactment, to make a recommendation in respect of the matter that is the subject of those proceedings

    Following deliberations the Chairman returned to the open section and moved:

    1. That having considered the submissions and reports in regard to this objection, the proposed works to install a stormwater drain through 68 Huia Road, Point Chevalier, identified as Option 5 in the report from Manager Stormwater Projects dated 4 April 2006 be abandoned.

    CARRIED

    There being no further business the Chairman declared the meeting closed at 3:20pm.
