  2. Top CONFIRMATION OF MINUTES

    That the minutes of the Works and Services Committee meeting held on 14 May 2007 be confirmed as a true and correct record.

  3. Top EXTRAORDINARY BUSINESS

    There was no extraordinary business.

  4. Top PUBLIC FORUM

    There was no public forum.

    The Group Manager, Environmental and Utility Management, took the opportunity to inform the committee that the Waiatarua Wetland project had won the two-yearly ARC Sustainable Environment Awards 2007 in the Sustainable Public Sector category. It was suggested that the Waiatarua Protection Society be advised of this recognition.

  5. Top REPORTS REQUESTED/PENDING

    1. That the Reports Requested/Pending list as at August 2007 be received.
    2. That the Waiheke Community Board be requested to acknowledge that item 4 in the Reports Requested/Pending list on the Works and Services committee agenda [Notice of Requirement: Owhanake Wastewater Treatment Plant] is still outstanding and that it will be resubmitted as a confidential item during the next term of the Community Board, prior to being referred to the appropriate council committee.

    That item 7 be taken at this point.

  6. Top SUBMISSION ON PROPOSED NATIONAL POLICY STATEMENT ON ELECTRICITY TRANSMISSION

    1. That the Committee confirms the submission lodged by officers on the proposed National Policy Statement on Electricity Transmission dated 25 June 2007.
    2. That the Committee delegates Councillor Abel to present Council's views at the Board of Inquiry hearings on the Proposed National Policy Statement on Electricity Transmission set down for 27 August 2007 in Auckland, with Councillor Christian being the alternate.

  7. Top UPDATE ON WASTE EDUCATION

    1. That reporting to the relevant committee on progress in waste education continue on an annual basis with the next report due in August 2008.
    2. That the results of the waste audit be reported to the relevant committee in February 2008.

    That the Safeswim annual report for 2006/2007 be forwarded to relevant community boards for their information.

  10. Top URGENT DECISION ON A SUBMISSION ON THE PROPOSED NATIONAL ENVIRONMENTAL STANDARDS FOR TELECOMMUNICATIONS FACILITIES

    A copy of the urgent decision was tabled.

    That the urgent decision on a submission on the proposed National Environmental Standards for Telecommunications Facilities be noted, ie:

    That the urgent decision be approved to enable the lodging of a submission on the proposed National Environmental Standards within the statutory timeframe.

  11. Top HOBSON SEWER OUTFALL APPEAL UPDATE

    That the resolution from the Ngati Whatua o Orakei Reserves Board 17 May 2007 meeting be received, ie:

    1. That the Reserves Board receives the Environment Court decision confirming that the Okahu Bay pumping station outfall will re-use the existing sewer lines already in place.
    2. That the Reserves Board advises the Works and Services Committee that the Board supports improvements to the existing outfall at Okahu Bay.

    1. That the public be excluded from the following part(s) of the proceedings of this meeting.

    The general subject of each matter to be considered while the public is excluded, the reason for passing this resolution in relation to each matter, and the specific grounds under Section 48(1) of the Local Government Official Information and Meetings Act 1987 for the passing of this resolution are as follows:

    This resolution is made in reliance on Section 48(1)(a) of the Local Government Official Information and Meetings Act 1987 and the particular interest or interests protected by section 6 or section 7 of that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public are as follows:

    Tender for Recyclables Collection Services

    The public conduct of the part of the meeting would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2)(b)(ii) The withholding of the information is necessary to protect information where the making available of the information would be likely unreasonably to prejudice the commercial position of the person who supplied or who is the subject of the information.

    In particular, the report contains information which is commercially sensitive and would be likely to unreasonably prejudice the commercial position of the organisation which supplied the information. It also allows Council to carry out, without prejudice or disadvantage, commercial activities.

    S48(1)(a)

    The exclusion of the public from the part of the meeting is necessary to enable the local authority to deliberate in private on its decision or recommendation.

    Possible site for resource recovery park

    The public conduct of the part of the meeting would be likely to result in the disclosure of information for which good reason to withhold exists under section 7.

    Section 7(2)(h)

    To enable the Council to carry out, without prejudice or disadvantage, commercial activities.

    In particular, public knowledge of information within the report would affect final purchase price.

    Section 7(2)(i)

    To enable the Council to carry on, without prejudice or disadvantage, negotiations (including

    commercial and industrial negotiations).

    In particular, the negotiations with private landowners could be impacted if information in this report is made public.

    S48(1)(a)

    The exclusion of the public from the part of the meeting is necessary to enable the local authority to deliberate in private on its decision or recommendation.

    1. That Mr Roger Mills of Mitre Consultancy be permitted to remain at this meeting after the public have been excluded as he is project managing the refuse and recycling contracting processes and his in-depth knowledge of these processes will be of assistance in relation to the matter to be discussed.
