Delegations of community boards

Traffic and roads

  1. To appoint a board member with whom the manager Traffic and Roading Services shall consult over roading and traffic matters, including parking.

  2. Responsibilities and powers of council under Section 344 of the Local Government Act 1974. (This refers to gates and cattle stops across roads).

  3. To hear and determine objections to the provision of a vehicle crossing (Section 335 Local Government Act 1974).

  4. To liaise with the NZ Police Department on local traffic control in terms of council’s contract with the police.

  5. To appoint a board member with whom the manager Recreation and Community Services shall consult over road closures.

  6. The naming of new streets including existing unnamed streets or the renaming of streets, in accordance with agreed procedures.

    Note:
    The renaming of a street requires the council to undertake a special consultation process as prescribed under Section 82 of the Local Government Act 2003.

    1. To consider and determine all applications for street trading activities of local significance other than those matters delegated to staff, in accordance with the provisions of the bylaw as follows :

      Community boards may nominate areas which :

      1. may be exempt from the requirements to obtain a licence, or

      2. may be designated as a "no street trading area", subject to any conditions which may be imposed by the community board.

    2. To set fees for all street trading activities other than where street activities are to take place city-wide or in more than one ward area, taking into account the valuation manager’s recommendations based on current market values.

Signs and banners

    1. To appoint a board member with whom the manager Auckland City Environments shall consult over the approval of signs which do not comply with the consolidated bylaw.

    2. All signs which are non-complying or discretionary activities under the district plan shall be referred to the relevant community board spokesperson for comment.

  1. To appoint a board member with whom the manager Auckland City Environments shall consult over the approval of banners over roads.

  2. To appoint a board member with whom the Chairperson, Recreation and Events Committee and the manager Community Services shall consult over the approval of commercial sponsorship signs in sports parks.

  3. To nominate a number of areas for the placement of election/by-election and referendum signs on council property and in public places.

Trees

    1. To approve (or refer for hearing those not approved) applications for the removal of trees on roads (clause 5C.7.3.3B isthmus plan) not delegated to the manager Recreation and Community Services or to their staff.

    2. To determine applications for the removal of trees on unzoned land.

  1. To appoint a board member as a tree spokesperson with whom council officers and consultants shall consult on planning applications for the removal of trees.

Planning issues

    1. To appoint a board member with whom an officer shall, and the Regulatory and Fixtures sub-committee can consult as to whether a proposed non-notified, non-complying land use application should be notified or not. Those applications going to the planning fixtures sub- committee shall be referred to the community board spokesperson for comment to the Regulatory and Fixtures sub-committee, except where the application is non-complying for no other reason then the bonding of a financial contribution.

    2. To appoint a board member with whom an officer shall, and the Regulatory and Fixtures sub-committee can, consult as to whether a proposed non-notified, non-complying subdivision application should be notified or not. Those applications going to the Regulatory and Fixtures sub- committee shall be referred to the community board spokesperson for comment to the Regulatory and Fixtures sub-committee.

  1. To provide local input to district plan reviews and council’s strategic plan.

  2. In respect of the proposed or operative district plan, or any changes or variations to it or any notices of requirement, the power to make submissions on it, but not the right to appeal a council decision to the Environment Court. Proposed changes and notices of requirement shall be notified to the board via the ward manager.

  3. To advise council on local urban design proposals.

Parks and reserves

  1. To classify or reclassify local parks and reserves, approve management plans, and to make all local decisions and to exercise the powers of the council under the Reserves Act 1977 or any other statute, or regulation or bylaw relating to the maintenance and operation of local parks and reserves, except where the exercise powers:

    1. Has been delegated to council officers; or

    2. Would have significance beyond the community board’s district or otherwise involves a matter of national importance (Section 6 Resource Management Act 1991); or

    3. Would commit the council to unbudgeted expenditure; or

    4. Involves the alienation of any part of a proposed or existing esplanade reserve by way of width reduction, easement, lease or otherwise.

      Note:

      1. This delegation includes the approval of the terms and conditions of new lease agreements – refer to the delegations to the manager Community Planning.

      2. Lease renewals on local parks and reserves may be negotiated by the community project manager (assets) with the approval of the relevant community board.

      3. Parks having citywide significance as determined by the Recreation and Events committee are not local parks and are excluded from the above delegations.

  2. The naming or renaming of local reserves and parks in accordance with agreed procedures.

  3. To approve temporary encroachments onto local reserves and access over, with power to set conditions including time, rent, fencing and reinstatement following the statutory process which includes approval by the minister.

Events

  1. To appoint one representative per board as a member of a consultative group (convened by the council) that reviews the programme of recreation events run by the council, on a yearly basis.

  2. To appoint a board member to advise the manager Recreation and Community Services on the effect of planned events on local neighbourhoods. The board’s representative shall be advised of events that involve over 100 people, liquor; or road closures.

Budget/annual plan

  1. To prepare an annual submission on local authority activities and service levels during consideration of the annual plan. Officers to consult with and inform community boards of budget and the annual plan as early as possible each year.

  2. To make recommendations on local capital works priorities.

  3. To allocate any funds given to the board for "community support" purposes.

  4. To make decisions on small local improvement projects (SLIPS) in accordance with an annual grant from council and in accordance with the guidelines established.

  5. To make recommendations for grants from New Zealand Sport and Recreation Agency funds in accordance with the commission's guidelines. This applies to 60 per cent of commission funds that are allocated to ward.

    Note:
    The remaining 40 per cent will be distributed city-wide by Recreation and Events Committee after consultation with community boards. The exception is the Hauraki Gulf ward, where 100 per cent of the funds allocated are distributed within the ward.

  6. To recommend projects from the financial contributions fund (community boards recommend projects from 60 per cent of the level of financial contributions collected in their community board area.)

Community facilities

  1. To agree the use and general terms of the leases of community halls and other local community facilities in accordance with council guidelines.

  2. To appoint a board member with whom the manager Recreation and Community Services shall consult with over the waiver or setting of fees and/or bonds for the hire of community facilities.

Liquor licencing

  1. To appoint a board member with whom the inspector (Auckland District Licensing Agency) shall advise and consult for new or amended applications for licensed premises.

Advocacy

  1. To make submissions on legislation to the City Advocacy Committee.

  2. To make submissions to external agencies (including government agencies) on local issues through the City Advocacy Committee.

Disposal of council owned property

  1. To make recommendations on proposals to dispose of any council owned property in the ward.

Dog exercise areas

  1. To recommend appropriate dog exercise areas in the community board area.
