2.0 Considerations

2.1 Statutory

2.1.1 Auckland City District plan

The Auckland City District Plan, Isthmus Section - Operative 1999 sets out the criteria and considerations for which resource consent is required prior to carrying out planting at the One Tree Hill summit. The following bullet below summarise these:

  • the site of the proposed planting is an archaeological site (refer Planning Map: F10/05). Part 5C of the District Plan precludes the excavation, alteration, and /or damage of an archaeological feature without resource consent (refer Section 5C.7.4.3)
  • in addition, no person is permitted to plant any vegetation on or within the vicinity of any scheduled archaeological site, nor within a certain distance of items of historic significance, which in the opinion of Council is likely to cause damage or detract from the feature for which the item has been scheduled
  • the pine tree was removed under emergency provisions of the District Plan. This did not include the removal of the stump. A resource consent is being processed to complete this work
  • the stump removal will affect an area with a diameter of 6.0 metres (centred upon the stump of the previous pine tree - see photograph 3.3.1) and 1.0 metre deep. In accordance with NZ Historic Places Trust approval has been obtained by the council
  • the proposed planting is limited to the same area that will be modified as a result of the stump removal application, and has been carefully designed to minimise impact on the archaeological site so that there will be an extremely minor impact on the archaeological feature
  • the type of consent required under this District Plan provision is a land use consent for a discretionary activity. Section 104 of the Resource Management Act provides the matters that must be considered when assessing the application, and there are criteria in the District Plan that must be used to assess the resource consent application (refer Section 5C.7.4.3B)
  • the site lies within the protected surrounds of the One Tree Hill Obelisk, which is a scheduled item of historical importance (refer Planning Map: F10/11). Rule 5C.7.1.3 of the District Plan provides the means to carry out work in this area as a discretionary activity. In addition to Section 104 of the Resource Management Act, there are criteria that must be considered in respect of such works set out at Clause 5C.7.1.3E(b) of the District Plan
  • the site is also located near the grave of Sir John Logan Campbell (refer Planning Map: F10/11). The proposed planting falls outside this Building Scheduled for Protection Area.
    Although this characteristic of the proposed tree planting does not trigger a resource consent requirement, this area has been considered in the design of the methodology to carry out the proposed works.

2.1.2 One Tree Hill Domain/Maungakiekie management plan

The One Tree Hill Domain/Maungakiekie Management Plan - 1998 is a statutory document that has been developed in compliance with the Reserves Act 1977.

The Management Plan emphasises the archaeological, cultural and landscape significance of the site and provides policy for the replacement of the summit tree.

The Management Plan provides guidelines for the replacement of the summit tree. Policies outlined in Sections 3.8 and 3.9 emphasise the following.

  • the retention of the dominance of a single tree on the summit
  • the replacement of existing trees, where necessary with specimens of similar growth habit suited to the location
  • replacement of the pine tree on the summit when necessary with a tree suited to the exposed conditions
  • the implementation of a contingency plan to ensure that a suitable replacement tree is available for transplanting as and when required.
