Notice of sale

Auckland City Council operates an online service for registered solicitors to advise us of any notice of sale and sales details for properties within the Auckland City boundaries.

How it works

The initial notice of sale request can be made by either the vendor solicitor or the purchaser solicitor, but in either case, the solicitor must be a registered customer.

The solicitor acting on behalf of either party can initiate the notice of sale request by searching for the correct property and enter the relevant details. An email is generated and sent to the solicitor for the other party, who completes or confirms the information. Either party can then submit the notice of sale request, which will automatically notify Auckland City Council to update the property details.

At each stage of the notice of sale process, the solicitors can log in and check the status of the notice of sale:

  • Entered (notice of sale initially logged)
  • Awaiting update (awaiting update from either solicitor)
  • Lodged (submitted for council to update)

At any stage before council has processed the notice of sale request, changes can be applied. Should any changes be made, an email will be sent to both solicitors advising them a change has been made so they can view the changes.

It is also possible for one solicitor to submit a notice of sale for both parties, this is most likely to the case over change to due to family or related parties transactions e.g. a will or trust creation.
When a notice of sale has been successfully received, the system will send a confirmation email to the solicitors involved.

The information that you require to complete a notice of sale can include the following:

  • Address of the property*
  • Title*
  • Legal description*
  • Details of the current owner*
  • Details of the new owner including mailing address
  • Sale Price and GST where applicable
  • Agreement date
  • Settlement date
  • Details of solicitors for both parties
  • The notice of sale type
  • Details of any long term leases
  • A copy of the lease where it affects the ratepayer. This can either be attached as an electronic file or posted

* This information will be automatically populated on the transfer of ownership form once you select a property. A comments box is available for you to note any variations between this information and the information you have.

The notice of sale online service is available to solicitors who are registered users with Auckland City Council.
