Which policy applies

A consent application may be subject to financial contributions, or to the 2005, 2006 or 2007 policies. The arrangements for transition between these policies are included in section 9 of each policy.

When was the consent accepted for lodgement?


Consent accepted for lodgement on or after 1 July 2008

This consent will be subject to development contributions in full, in terms of the 2007 policy, however this may change depending on the outcome of the public consultation on the draft 2008 policy.


Consent accepted for lodgement between 1 January 2008 and 30 June 2008

If the development is in the area subject to the isthmus section of the district plan, then this consent will be subject to development contributions in full, in terms of the 2007 policy.

If the development is in the area subject to the central area section of the district plan, then do either of the following apply?

  • one or more consent applications (which were subject to financial contributions or development contributions under an earlier policy) for the same development had been accepted for lodgement before 1 July 2007, and have not lapsed
  • for non-residential developments only, one or more consent applications for the same development had been accepted for lodgement before 1 July 2007, and either have not yet been granted, or were granted on or after 1 July 2002, and have not lapsed.

If "yes", then the development is considered to be "underway before 1 July 2007". In this case, this consent will be subject to whichever of the 2006 policy or the 2007 policy gives the lowest total charge (unless the applicant wants the consent to be subject to the other of these two policies).

If "no", then this development is considered to not have been "underway before 1 July 2007". In this case, this consent will be subject to development contributions in full, in terms of the 2007 policy.

For the avoidance of doubt, where a consent relates to a stage of a development other than one for which a financial contribution or development contribution under an earlier policy was required, full development contributions as provided for in the 2007 policy may be required for that other stage.


Consent accepted for lodgement between 1 July 2007 and 31 December 2007

Do either of the following apply?

  • one or more consent applications (which were subject to financial contributions or development contributions under an earlier policy) for the same development had been accepted for lodgement before 1 July 2007, and have not lapsed
  • for non-residential developments only, one or more consent applications for the same development had been accepted for lodgement before 1 July 2007, and either have not yet been granted, or were granted on or after 1 July 2002, and have not lapsed.

If "yes", then the development is considered to be "underway before 1 July 2007". In this case, this consent will be subject to whichever of the 2006 policy or the 2007 policy gives the lowest total charge (unless the applicant wants the consent to be subject to the other of these two policies).

If "no", then this development is considered to not have been "underway before 1 July 2007". In this case, this consent will be subject to development contributions in full, in terms of the 2007 policy.

For the avoidance of doubt, where a consent relates to a stage of a development other than one for which a financial contribution or development contribution under an earlier policy was required, full development contributions as provided for in the 2007 policy may be required for that other stage.


Consent accepted for lodgement between 1 January 2007 and 30 June 2007

This consent will be subject to development contributions in full, in terms of the 2006 policy.


Consent accepted for lodgement between 1 July 2006 and 31 December 2006

Do either of the following apply?

  • one or more consent applications (which were subject to financial contributions or development contributions under an earlier policy) for the same development had been accepted for lodgement before 1 July 2006, and have not lapsed
  • for non-residential developments only, one or more consent applications for the same development had been accepted for lodgement before 1 July 2006, and either have not yet been granted, or were granted on or after 1 July 2001, and have not lapsed.

If "yes", then the development is considered to be "underway before 1 July 2006". In this case, this consent will be subject to development contributions in full, in terms of the 2005 policy.

If "no", then this development is considered to not have been "underway before 1 July 2006". In this case, this consent will be subject to development contributions in full, in terms of the 2006 policy.

For the avoidance of doubt, where a consent relates to a stage of a development other than one for which a financial contribution or development contribution under an earlier policy was required, full development contributions as provided for in the 2006 policy may be required for that other stage.


Consent accepted for lodgement between 1 January 2006 and 30 June 2006

This consent will be subject to development contributions in full, in terms of the 2005 policy.


Consent accepted for lodgement between 1 July 2005 and 31 December 2005

Do either of the following apply?

  • one or more consent applications (which were subject to financial contributions) for the same development had been accepted for lodgement before 1 July 2005
  • for non-residential developments only, one or more consent applications for the same development had been accepted for lodgement before 1 July 2005, and either have not yet been granted, or were granted on or after 1 July 2000.

If "yes", then the development is considered to be "underway before 1 July 2005". In this case, this consent will not be subject to development contributions. It may be subject to financial contributions.

If "no", then this development is considered to have started on or after 1 July 2005. In this case, this consent will be subject to development contributions in full, in terms of the 2005 policy

For the avoidance of doubt, where a consent relates to a stage of a development other than one for which a financial contribution was required, full development contributions may be required for that other stage.


Consent accepted for lodgement before 1 July 2005

This consent will not be subject to development contributions. It may be subject to financial contributions.
