Engineering bonds

Engineering bonds allow you to deposit money with the council instead of undertaking work required by a subdivision.

For example, if an asset needs to be built as part of the requirements of a subdivision but for some valid reason (to be assessed by a council engineer) there is difficulty or a delay completing the work, a bond can be paid to allow the subdivision to progress. The outstanding work can be completed at a later date.

Bond money is deposited with the council before a 224c certificate is released.

The period of the bond depends on the amount paid. We may extend the period of the bond if there are special circumstances.

When the work has been completed, the person who applied for the bond application can apply for a refund.

If the work is not completed in a satisfactory way within the set timeframe, council staff or contractors may enter onto the land, complete the works, and recover the costs from the bond. Once the work has been completed, the balance of the bond, if any, will be refunded.
 

When engineering bonds can be paid

Bonds will only be accepted if

  • there are legitimate grounds
  • the developer is able to demonstrate to the council the difficulty faced in completing the works.

Certain types of construction work, such as stormwater and wastewater reticulation, and water supply are not eligible for a bond. These works must be carried out. This is detailed in the council's Code of Urban Subdivision.

Bonds are not to be used to accelerate the 224c certification process.
 

What to include with an engineering bond application

The application needs to include:

  • two quotes from independent contractors on their company letterhead
  • a complete copy of the engineering conditions from the relevant subdivision consent
  • two copies of approved engineering plans detailing the location, dimensions and materials of the proposed bonded works
  • written consent from all affected landowners stating that they allow the required works to be undertaken and a written statement that they will pass on this obligation to any future owners of the affected property
  • the date by which the work will be completed.

A  deposit of $742.22 plus GST is required to administer the bond and inspect the works.
