Local Government Act (LGA) approvals
The Local Government Act (LGA) approval process helps developers and property
owners present an application under a formal process to the council to construct
drainage over neighbouring properties. This process is pursuant to Section 460
of the LGA (1974) and 181 of the LGA (2002).
This process should only be used when efforts through other private agreements
and arrangements have been exhausted with all affected neighbours. It should
also only be used when all viable alternatives have been exhausted.
The process involves a council engineer undertaking an investigation and
preparing a report on behalf of the applicant. This report is presented to the
formal council for consideration. Procedures and appeal rights are set out in
the Local Government Act, and must be followed.
Applications can be approved or declined by the Council, though decisions may be
appealed to the District Court.
Fees for administering the LGA process are charged to the applicant regardless
of the outcome.
