Questions once you've received your LIM

Once you have received your LIM you may have some questions about the content.

Financial contributions

Section 108 of the Resource Management Act 1991 allows Auckland City to collect financial contributions in accordance with the relevant District Plan.

If the financial contribution has not been paid, Auckland City can recover any outstanding amount(s) from a subsequent owner of the land.

Drainage and water reticulation plans

If any completed and inspected (as built) private drainage plans exist for this property, they will be included in the attachment section of your LIM, as will a public drainage map. If you have not received drainage plans for this property this may be due to:

  • if your LIM was faxed to you, the plans will not be included as they are in A3 format. They will be dispatched with the original LIM
  • no private drainage plans exist
    • the property is land only
    • there is no record of as built drainage due to the age of construction of the dwelling.
      Note: In this case, proposed drainage plans (drainage not completed or inspected) may be held - you would need to visit us to determine whether they are held. Refer to Drainage plans to find out where to go to view or obtain plans
  • there will be no public drainage maps if the property is located on Waiheke or Great Barrier Island as they have septic tanks.

Consents and permits issued

Prior to the introduction of the Building Act 1991 there was no legal requirement to keep records, so Auckland City may not actually hold specific permit details for original construction. This may explain why there are no consent details showing on the LIM.

Code Compliance Certificates

Prior to the Building Act 1991, Code Compliance Certificates (CCCs) were not required.

Building work done before 1991

Auckland City may have have a record of inspections relating to building work permitted before the Building Act came into effect in 1991. You will need to visit us to determine whether this information is available. Click here to find out where to go to view or obtain information held on the property.

Building work done after 1991

If the LIM shows that a CCC has not been issued for specific work, but you have evidence that it has been, contact inspections.

If a consent has been approved but the CCC has not been issued you will need to arrange an inspection to confirm compliance with the approved plans and standards. Contact inspections as below:

Compliance schedules

A compliance schedule is a document issued by Auckland City that lists building's mechanical features. It is required for any building (other than a building used as a single residential dwelling), that contains any of the systems outlined in Section 44 of the Building Act, eg fire alarms, lifts and emergency lighting systems.

Planning and planning maps

If you received your LIM by fax, you will not receive the District Plan Maps relating to the site as they are in A3 format. These plans indicate the degree of any issues highlighted in the planning text, so are not in effect additional information to the LIM. They will be dispatched with the original LIM.

Claims appearing on a LIM

If the LIM states that there is a claim against Auckland City, eg Weathertightness issue, you will need to visit our Property Information Centre at Graham St to view relevant documentation for more information.
