(Following a High Court ruling the section of the council's bylaw
dealing with the location of brothels is no longer valid.)
Apply for dispensation
If your business is affected by the Brothels and commercial sex premises
bylaw, you can apply for dispensation which we will consider on a
case-by-case basis.

Assessment of effects
You need to include a detailed assessment of the effects of your business
with your application. An assessment of effects should include:
- a description of your business
- where your premises do not comply with the location requirements set out
in 30.3 or 30.4 of the Auckland City Consolidated Bylaw, please give a
description of the sites which may be affected by your business (eg schools,
residential areas, places of worship)
- with reference to the above, provide an assessment of the effects of your
business on the identified sites, including details of any consultation
undertaken and any responses to views of those consulted
- a description of the methods to be adopted to help prevent or reduce the
effects of your business on the identified sites (eg security measures,
lighting, signage, design of access to the premises and operational
measures).
Submissions on applications for dispensation
Applications for dispensation from Part
30 of the bylaw will be publicly notified. All applications will be open for submission for 10 working days from the date of notification.

Making a submission
Note: A separate submission form must be used for each application for
dispensation.

Your submission must be in writing, dated, signed and include the following
information.
- your name and postal address along with any telephone and fax numbers
- details of the application your submission is about (including location)
- whether you support or oppose the application
- your submissions, with reasons
- the decision you wish the council to make
- whether you wish to speak in support of your submission at the hearing.
