Proposal to amend Auckland City Consolidated Bylaw

Statement of proposal to amend Auckland City Council Consolidated Bylaw regarding gate charges applying at the Waiheke Island refuse transfer station

Activity to be funded by the Waiheke Island refuse transfer station charges

The Council proposes amending clause 22.13.1 of the Auckland City Consolidated Bylaw 1998, which contains the charges applying for the disposal of refuse at the Waiheke Island refuse transfer station. The amended transfer station charges will be used to fund additional capital and operating expenses resulting from an upgrade of the existing Waiheke Island refuse transfer station site.

It is proposed that the costs associated with the upgrade be funded over a 10 year period starting in the 2004/05 financial year. Approximately 60 per cent of the costs would be met by an incremental increase in the gate charges applying to the transfer station of 16 per cent per annum. At the same time, following the installation of a weighbridge, the gate charges need to be changed from volume-based assessments to a weight-based system.

In addition, the council proposes increasing the charge for an additional official red rubbish bag from $2.50 to $3.50.

Proposed change to the bylaw

The proposed new clause 22.13.1 of the bylaw, which is to replace the existing clause 22.13.1, is as follows:

All proposed new charges would apply from 1 September 2004.

In terms of section 155 of the Local Government Act 2002, the Council considers that the most appropriate way of addressing this issue is through altering the charges as proposed above. Because the gate charges are currently set out in the Council's Bylaw, the only way of amending them is through an amendment to the Bylaw. It is considered that the proposed bylaw is the most appropriate form of bylaw to achieve the intention and that it does not give rise to any implications under the New Zealand Bill of Rights Act 1990.
