Application for resource consent

Auckland City Council has received applications for resource consent under the Resource Management Act 1991 for the following sites:

  •  725 Man O War Bay Road, Waiheke Island
  •  51 Summer Street, Ponsonby
  •  8 St Marks Road, 2 and 4A MacMurray Road, Remuera.

Application one

Site

725 Man O War Bay Road, Waiheke Island.

Details

The applicant, Man O War Station Ltd, proposes to construct a new dwelling, access to the dwelling and a boat shed at 725 Man O War Bay Road, Cactus Bay, Waiheke Island. The two buildings will be located in different parts of Cactus Bay - the dwelling within the eastern portion and the boat shed within the western portion, both set at the foot of a hill back from the bay. The single level dwelling will contain one bedroom, a bathroom, kitchen, living room, store room, dining room and outdoor decking.

The single-level boat shed will contain a sleep-out with bunkroom and bathroom. The structures will be clad with stained weatherboards, using timber window and door joinery and long-run colour steel roofing in a karaka colour tone.

The application site is within Land Unit 1 (coastal cliffs) under the operative district plan, and Landform 2 (dune systems) under the proposed district plan. Consent is required for the following reasons under the operative district plan and proposed district plan.

Operative district plan

  •  To construct a building that is within the wetland/water systems protection yard that is 7m from the nearest water system - discretionary activity.
  •  Within Land Unit 1, there is no applicable building height, as buildings are not provided for in the land unit. Accordingly, the height of any building less than 6m in height shall be assessed as a discretionary activity.
  •  Within Land Unit 1, no lot coverage is provided for. With a total lot coverage of 364m2 proposed for the new dwelling and boat shed and providing a total site building coverage of 1612.06m2 - the proposal is considered a non-complying activity.
  •  To undertake earthworks for constructing the dwelling and boat shed and access where no earthworks are permitted, with a total area of earthworks of approximately 2,075m2 proposed - restricted discretionary activity.
  •  Within Land Unit 1, vehicle accesses are not permitted. Therefore, the proposed vehicle access to the dwelling with an average gradient of 1:6.5 requires consideration as a non-complying activity.

Proposed district plan

  •  The construction of any buildings within Landform 2 is a non-complying activity.
  •  The undertaking of any activity within Landform 2, other than eco-source planting, is a non-complying activity. The proposal includes the construction of buildings, and access and planting of some non eco-sourced plant species.
  •  Within Landform 2, no building coverage is provided for. Therefore, with a total lot coverage of 364m2 proposed for the new dwelling and boat shed and providing a total site building coverage of 1612.06m2 - the proposal is considered a non-complying activity.
  •  Within Landform 2, there is no applicable building height, as buildings are not provided for in the land unit. Accordingly, the height of any building shall be assessed as a non-complying activity.
  •  To undertake earthworks for the construction of the dwelling and guest accommodation on site where within the Land Unit no earthworks area is provided for, with a total area of earthworks of approximately 2,075m2 proposed. This is a non-complying activity.
  •  Within Landform 2, there is no applicable wetland/water systems protection yard. Accordingly, as the proposal includes the construction of a structure in close proximity (7m) to a water system, it is considered a non-complying activity.

Overall, the application is considered a non-complying activity.

Application two

Site

51 Summer Street, Ponsonby.

Details

The applicant proposes to remove an existing pre-1940s building (and ancillary buildings) from the site and develop a new building comprised of three residential units (each with a basement, ground floor and first floor levels).

The site is zoned Residential 1 and the proposal requires resource consent for a number of matters under the district plan and proposed plan change 163.

This includes the removal of a pre-1940s building, development of a new building, infringement of the density control, earthworks, removal of a generally protected tree and works within the dripline of other generally protected trees.

Overall the proposal requires consent as a non-complying activity.

Application three

8 St Marks Road, 2 and 4A MacMurray
Road, Remuera.

Details

The proposal involves the establishment of expanded medical facilities for the Auckland Eye Clinic, a specialist eye care centre. The clinic presently occupies a site at 8 St Marks Road, which is on the northwest corner of the St Marks Road and MacMurray Road intersection.

It is proposed to expand the existing facility by providing additional operating and associated facilities on the sites at 2 and 4A MacMurray Road, which are located immediately to the east of the existing clinic site.

The proposed new building will house three theatre suites, recovery, reception, support and staff areas on the ground floor, with two laser suites and an overnight stay facility located on the first floor. The basement level contains building services areas only. The proposed building will have a total floor area of 1000m2 and provision will be made for an additional 42 parking spaces on site. There will be no changes to the footprint of the existing building, although a number of internal changes will be made. Resource consent is required for a number of reasons including the following.

Establishment of a healthcare service in a residentially zoned site, the removal of 14 generally protected trees, work within the dripline of five generally protected trees, 2250m2 of earthworks, development control modifications relating to height, paved impermeable surfaces, landscaped permeable surfaces, parking shortfall and inadequate
on-site manoeuvring space. Overall, the proposal is a discretionary activity under the Auckland City Operative District Plan 1999 - isthmus section.
