Private plan change notification

Proposed plan modification 219 - Kohimarama Retirement Village, 223 Kohimarama Road and 7 John Rymer Place, Kohimarama.

At its meeting on 10 April 2008, Auckland City Council agreed to accept and notify proposed plan modification 219, which is a private plan change request under the Resource Management Act 1991.

This application from Education Holdings Limited relates to vacant land at 223 Kohimarama Road and 7 John Rymer Place, Kohimarama (land directly south of Selwyn College).

The private plan change seeks to rezone all the land from special purpose 2 (education) to special purpose 1 (health) and apply a concept plan for future development (C14-05).

The dominant activity proposed in the concept plan is housing for the elderly or disabled/retirement village.

The concept plan lists the activities provided for as permitted or restricted discretionary activities and sets out the development controls that apply.

The concept plan includes development control rules and identifies future building platforms, maximum height of buildings, minimum yard setbacks, landscaping and boundary treatments, and vehicle and pedestrian access.

Making a submission

Any person may make a submission on the proposal. Submissions close on Friday, 6 June 2008.

The process for public participation in the consideration of a proposed plan modification under the act is as follows.

  •  After the closing date for submissions, the council must prepare a summary of the submissions and this summary must be publicly notified.
  •  There must be an opportunity to make further submissions in support of, or in opposition to, the submissions already made.
  •  If a person making a submission asks to be heard in support of his or her submission, a hearing must be held.
  •  The council must give its decision on the proposal (including its reasons for accepting or rejecting submissions).
  •  Any person who has made a submission has the right to appeal the decision on the proposed plan modification to the Environment Court.
