Proposed plan modification

Auckland City Council has prepared the following plan modification to the central area district plan under the Resource Management Act 1991 (RMA).

Proposed plan modification 9 is a plan change that seeks to amend part 15.5 general rules and other related parts of the operative central area district plan (central area section 2004), including part 14.7 Viaduct Harbour Precinct to enable the continued use of the central area of Auckland city as a live and vibrant place through the facilitation of temporary activities such as events and art works.

The plan change will allow temporary activities or events up to 21 days as permitted activities where an event permit has been issued under the relevant bylaws and where noise controls are complied with. All other events will continue to require a resource consent whilst acknowledging that events less than 21 days duration and complying with noise controls can be processed without public notification. More flexible provisions are introduced for temporary static and or non-noisy artworks and for activities and structures associated with major events such as the Rugby World Cup 2011.

Consequential amendments are proposed to the policies of part 3 - Resource Management, part 14.2 - Public Open Space Precincts and part 16 - Definitions, including definitions for event, event permit and major event.

Submissions close on Monday, 27 October 2008. Your submission must be in the format outlined in the Resource Management Act. You can print submission forms that follow this format or get them from the places listed above.

Any person may make a submission on the proposal. Lodge your submission:

  • online (conditions apply, see this site)
  • at level 11, Civic Administration Building, 1 Greys Avenue, central city.

Taking part

(Taken from the Resource Management Act 1991).

The process for public participation in the consideration of a proposed plan modification under the Act is as follows.

  • After the closing date for submissions, the council must prepare a summary of the submissions and this summary must be publicly notified; and
  • There must be an opportunity to make further submissions in support of, or in opposition to, the submissions already made; and
  • If a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
  • The council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and
  • Any person who has made a submission has the right to appeal the decision on the proposed plan modification to the Environment Court.
