Liquor prohibition - Mission Bay Jazz and Blues Streetfest

Auckland City Council has resolved to prohibit the consumption or possession of liquor within the following public places and during the following specified periods.

This liquor prohibition is notified under the council's Liquor Control in Public Places Bylaw, made under section 147 of the Local Government Act 2002.

Time and dates of liquor prohibition

The time and dates of liquor prohibition are between noon on Saturday, 28 February and 1am on Sunday, 1 March (or at the same times on the rain date of Sunday, 1 and Monday, 2 March) for the locations listed below (excluding licensed areas).

  • Mission Bay beach and Selwyn Reserve, including the Millennium Bridge, and the western and eastern car parks, excluding licensed areas.
  • Tamaki Drive, from the Millennium Bridge to Selwyn Avenue.
  • Atkin Avenue, from Tamaki Drive to Marau Crescent.
  • Marau Crescent, from Atkin Avenue to Tamaki Drive.
  • Patteson Avenue, from Marau Crescent to Tamaki Drive.

Areas of prohibition

The liquor ban only applies to the designated areas mentioned above. It does not affect licensed premises (including outdoor seating attached to licensed premises) or private property.

The law allows you to take liquor through public places within the ban area to and from residences and licensed premises as long as the liquor is promptly removed from the public spaces within the ban area.

Powers of the police

It is an offence for you to disobey the liquor ban. The police can arrest you if you commit an offence against the liquor ban, or if they have reasonable cause to suspect that you have done so.

The police can immediately and without further notice search vehicles or containers (including bags) to see if they contain liquor. The police can seize liquor connected with an offence.

You can be fined up to $20,000 if convicted.

Definition

In this notice, "liquor" means liquor as specified in the Sales of Liquor Act 1989.
