District plan changes

A. Decisions
At its meeting of 26 February 2009, the council made its
decisions on the submissions of the following plan modifications.
Plan Modification No 196: plan change - Newmarket Growth
Area Structure Plan
As a result of the hearing the plan change has been
approved with amendments.
These changes include amendments to the:
- objectives and policies
- status of certain activities
- assessment criteria
- maximum height and other development controls
- car parking and cycle storage provisions
- extent of the land identified as part of the Newmarket
Growth Area Structure Plan
- properties to be rezoned
- extent of the retail frontage and verandah controls
- properties identified as character buildings
- extent of the core and outer parking areas.
It also includes the removal of specific controls for the
site at 314-390 Khyber Pass Road.
Plan Modification No 223: private plan change - 781,791 and
793 Great South Road
As a result of the hearing the plan change has been
approved. Plan modification 223 is a plan change to re-zone land at 781, 791 and
793 Great South Road, Penrose. The request is to re-zone various areas of land
within the site from Open Space 1 to Business 6, from Special Purpose 3 to
Business 6 and from Business 6 to Special Purpose 3. The purpose of the plan
change is to facilitate the development of the land for business purposes.
B. Operative plan changes
At its meeting of 26 February 2009, the council approved
the following plan modifications.
Plan Modification No 210: plan change - 42 Herd Road, to
the isthmus district plan
Plan modification 210 is a plan change that re-zones land
at the Selwyn Heights Retirement Village located at 42 Herd Road from
residential 6a to special purpose 1 and applies a concept plan to the site. The
plan change has been amended as a consequence of a consent order issued by the
Environment Court on 24 November 2008.
Plan Modification No 2: plan change - urban design and
residential amenity controls, to the central area district plan
Plan modification 2 introduces a "design-based approach" to
those areas of the central area without urban design controls. It introduces a
requirement for building development to obtain restricted discretionary resource
consent and the assessment of these applications against a comprehensive suite
of design criteria. It also introduces residential amenity controls including
minimum residential apartment standards.
The plan change has been amended as a consequence of
appeals to the plan modification being resolved by consent orders from the
Environment Court. Both plan changes will become operative on 13 March 2009.
