Traffic Amendment Bylaw No 1 of 2008

At its meeting of 23 April 2009 the council resolved to amend the Auckland City Council Traffic Bylaw 2006 by making the Auckland City Council Traffic Amendment Bylaw No 1 of 2008. The new bylaw came into immediate effect.

The amendment bylaw makes the following amendments to the Traffic Bylaw 2006.

  • Inserts a definition of all-terrain vehicle and amends references to the Hauraki Gulf islands in clause 25.21 and inserts new clauses 25.22.1, 25.22.2 and 25.22.3 that allow some roads on the Hauraki Gulf islands to be restricted for use by all-terrain vehicles (quad bikes) and motorcycles only.
  • Adds clauses 25.2.2 and 25.3.2 and renumbers affected clauses to allow the council to regulate the use of roads for one-way traffic or restrict left or right turning traffic by resolution. Schedules 1 and 1a are revoked but the council by resolution ensured that the restrictions contained in schedules 1 and 1a continue in effect.
  • Insert the words "by resolution" in the introductory sentences of clauses 25.3.3 (previously numbered 25.3.2), 25.8.1, 25.9, 25.10, 25.13.1, 25.14.1, and 25.18.1 so that regulation of bus lanes, one-way roads, turning restrictions can occur by resolution where this is appropriate.
  • Inserts a new clause 25.7.2 and renumbers affected clauses to allow the council to designate by resolution those areas where access by heavy motor vehicles is prohibited.
  • Inserts the words "designated by the council as prohibited" in clause 25.7.1 and delete the words "shown on the map in Schedule 2" to align the clause with the proposed amendment to determine areas prohibited to heavy vehicles by resolution. Schedule 2 is revoked but the council by resolution ensured that the restrictions contained in schedules 2 continue in effect.
  • Deletes the words "Schedule 3" and replaces them with the words "Schedule 1B of the Land Transport (Offences and Penalties) Regulations 1999" in clause 25.15.10 to remove the requirement that the bylaw has to be amended whenever the maximum infringement fines that may be imposed for parking offences are amended. Schedule 3 is revoked.
  • Deletes clause 25.17.4 and renumbers affected clauses to remove the exemption to allow for the use by other vehicles of special vehicle lanes for a distance of 50 metres contrary to the Land Transport (Road User) Rule 2004.
  • Inserts the words "payment or" and "specified in the permit" in the definition of "residents exemption permit" so that holders are not subject to parking fees, where appropriate.
  • Amends the definition of road in clause 25.1 by adding the word "any" at the start of subclause (i), by deleting the words "that Act" from the paragraph following subclause (i) in the definition of road and substituting them with the words "the Land Transport Act 1998", and changing the indenting to clarify that the paragraph qualifies the whole definition and not just subclause (i).
  • Adds an introductory explanatory note at the beginning of the bylaw that states that the bylaw shall be known as the Auckland City Council Traffic Bylaw 2006 and amending references to "this Part of the Bylaw" to "this bylaw".

The Auckland City Council Traffic Bylaw 2006 with the Auckland City Council Traffic Amendment Bylaw No 1 of 2008 can be viewed in all community libraries and online.
