Bylaw administration bylaw

Invitation to have input into the review of the Bylaw Administration Bylaw and minor consequential amendments to other bylaws.

Summary of information

Auckland City Council is reviewing its Bylaw Administration Bylaw. The existing bylaw (part 1 of the Auckland City Consolidated Bylaw 1998) contains provisions that apply to the administration and enforcement of all of the council's bylaws.

During the period of 2004-2008, Auckland City Council reviewed all parts of the Auckland City Consolidated Bylaw 1998, including substantial sections of part 1. A number of definitions that were included within part 1 are now included in the reviewed stand-alone bylaws and are no longer required in part 1. Other definitions are no longer relevant to the new bylaws. It is proposed that part 1 be reviewed and becomes the Bylaw Administration Bylaw 2009 and only a few definitions that apply to a number of bylaws be included within this new bylaw.

A number of other minor changes are also proposed, so that it is clear that most of the provisions of the new Bylaw Administration Bylaw (eg requirements for licences, permits and approvals, dispensations) apply to all of the council's bylaws.

The review of the Bylaw Administration Bylaw has also meant a number of minor consequential amendments should be made to other bylaws including:

  • making reference in the explanatory notes of those bylaws to the Bylaw Administration Bylaw for the definition of words that are not defined in those bylaws
  • the inclusion of definitions that were in Part 1 into those bylaws where this is appropriate for better understanding
  • adding new definitions into some of the bylaws that help with the interpretation of those bylaws
  • correcting minor typographical errors.

At its meeting of 23 April 2009, the council resolved to undertake the special consultative process under the Local Government Act 2002 to invite submissions on its proposal to introduce a new Bylaw Administration Bylaw and to make minor consequential changes to other bylaws.

A copy of the proposed new bylaw and a statement of proposal, which provides the reasons for the proposed bylaw and the analysis that has gone into its development, are available from:

Submission period

You can make a submission on the proposal to introduce the new Bylaw Administration Bylaw.

The written submission period begins on Monday, 11 May and closes on Wednesday, 10 June.
