5 Carlton Gore Road

Auckland City Council has agreed to accept and notify proposed plan modification 195 which is a private plan change request under the Resource Management Act 1991 (RMA). Proposed private plan change 195 is a plan change that seeks to rezone the site at 5 Carlton Gore Road from residential 7B to mixed use.

Newmarket Gully combined sewer overflow mitigation and associated works

Auckland City Council gives notice of a requirement for a designation for public works under Section 168 of the Resource Management Act 1991. The requirement from Watercare Services Limited is for a designation to enable the construction, operation and maintenance of work to mitigate sewer overflow effects in the Newmarket Gully. The work will include:

  • construction, operation and maintenance of a storage tank to store wastewater during wet weather, releasing the wastewater back into the sewer when the wet-weather flows recede
  • upgrading, use and maintenance of an existing access road from Ayr Street to the proposed storage tank to enable construction and ongoing maintenance of Watercare facilities
  • placement of fill and planting of trees, shrubs and other vegetation to integrate the works with the surrounding landform
  • ongoing operation and maintenance of the facility once constructed.

The proposed mitigation work and the land affected are identified on the plans that accompany the notice of requirement.

Watercare Services Limited advises that this notice of requirement is necessary in order to achieve Watercare's objectives, as the work will provide for:

  • a reduction in the volume and quantity of wastewater overflows to Newmarket Stream
  • a potential reduction in odour levels emanating from the subject area
  • an improvement in the function of the stream and estuarine habitats
  • the enhancement of a portion of the reserve through which the work proceeds.

You must also serve a copy of your submission on Watercare Services Limited at the address for service below as soon as is reasonably practicable after serving your submission on the council.

Making a submission

Any person may make a submission on these plan modifications. Your submission must be in the format outlined in the Resource Management Act 1991. You can print submission forms that follow this format or get them from the places listed above.

You can lodge submissions:

  • by post to Auckland City Council, Private Bag 92516 Wellesley Street, Auckland 1141 (Attention: lead notification specialist, City Planning)
  • online (conditions apply, see this site)
  • Lodge your submission at level 11, Civic Administration Building, 1 Greys Avenue, central city.

Taking part

The process for public participation in the consideration of a proposed plan modification under the Act is as follows.

  • After the closing date for submissions, the council must prepare a summary of the submissions and this summary must be publicly notified; and
  • There must be an opportunity to make further submissions in support of, or in opposition to, the submissions already made; and
  • If a person making a submission asks to be heard in support of his or her submission, a hearing must be held; and
  • The council must give its decision on the proposal (including its reasons for accepting or rejecting submissions); and

Any person who has made a submission has the right to appeal the decision on the proposed plan modification to the Environment Court.
